open-container law?

Gearing up for tonight's festivities, I'm curious as to the actual open-container laws here. I tried googling, to no avail.

The past few years, I had no problems carrying around/drinking cheap champagne while walking back through the Common after the fireworks at the Harbor, but I was told Mumbles is promising less leniency this year.

okay, ianal, but i believe the laws about drinking in public are city and town ordinances, not state laws. the state laws cover alcohol in your cars, transporting alcohol, buying and selling alcohol, etc. but not alcohol in public.

so, assuming you are going to first night in boston, the local law o' the land there says this:

"16-12.28 Drinking of Alcoholic Beverages in Public. No person shall drink any alcoholic beverage as defined in Chapter 138, Section 1 of the General Laws of the State, or possess an open container, full or partially full, of any alcoholic beverages, while on, in or upon any public way, upon any way to which the public has right of access, in any place to which members of the public have access as invitees or licensees, in any park or playground, conservation area or recreation area, on private land or place without consent of the owner or person in control thereof.
(CBC 1975 Ord. T14 ยง 312; Ord. 1982 c. 21 s 1; Ord. 1982 c. 23 s 1) "

there has been some debate about what is public vs. what is private, but in general i wouldn't try to test that line. essentially open containers are illegal in boston.
