Alleged stabber in Dorchester road-rage incident released on bail; victim expected to face charges as well

Colum Flaherty of Quincy was released on $500 bail following his arraignment today on charges he used a knife on a man who apparently stopped to complain about traffic delays caused by an accident Flaherty was in at Morrissey Boulevard and Freeport Street yesterday afternoon, the Suffolk County District Attorney's office reports.

Flaherty, 64, was arraigned in Dorchester District Court. DA spokesman Jake Wark adds his alleged victim, a 54-year-old Quincy resident, faces legal trouble of his own: "He is expected to face a count of assault and battery on a person over 60 and other offenses for allegedly striking Flaherty in the confrontation that preceded the stabbing."

Flaherty was exchanging papers with a man who had just rear-ended him around 3 p.m. when the other driver allegedly pulled in front of them and approached them in a threatening manner to complain about the delay they were causing.

Why is the "over 60" thing still on the books? We're now at a point where most people are up and active until well past that, and if they ARE in only in their 60s and are frail or disoriented or whatever, then the "person with a disability" statute covers them. It should be amended to over 75 or 80 or something if we're looking to suggest that the person couldn't defend themselves because of typical senior decline.
