MassBeacon.com reports that state Rep. John Binienda (D-Leicester, Worcester), has filed legislation that Binienda says would make it illegal to put up a fake political Web site or one that uses a candidate's name to link unsuspecting Web users to "offensive or obscene material, prospectively damaging the reputation and good name of an incumbent or candidate."

The bill, H.557, doesn't actually say anything about offensive or obscene matter, let alone define it, but maybe that got added in when it was discussed by the Election Laws Committee earlier this week. The proposed law would carry penalties of up to six months in prison and a $1,000 fine.

If it's "offensive or obscene matter," dissing on a candidate then wouldn't the first amendment protect it as parody? Since it obviously wasn't put up by the candidate? It would only be professional and appropriate fake websites that would actually cause confusion and spread misinformation, right?
