Man out on bail on gun charge arrested for October murder near Ruggles

Daniel Yarde, 22, of Mattapan, was arrested this morning on charges he shot DeAndre Russ to death, early on Oct. 28 at 1050 Tremont St., the Suffolk County District Attorney's office reports.

Prosecutors say the two men took the same elevator down from a Halloween party around 3 a.m. and that they got into an altercation outside that ended with Yarde shooting Russ repeatedly.

The DA's office says Yarde was free on $5,000 bail for charges related to an October, 2010 incident in which MBTA Transit Police stopped him for fare jumping at the Ashmont T stop and then, on a frisk, found a gun on him.

Why was that thug out in the first place? Isn't there a mandatory one year in jail? Or did his public defender pull the usual "that racist cop profiled him" BS so the charges didn't stick?
