Forget cupcakes in jars: TSA marshal under investigation for alleged attack on Occupy Boston organizer

Wired reports on one of the more bizarre events in the hours before Boston Police raided and shut down Occupy Boston last month: A man who turned out to be a TSA air marshal was arrested on charges he slapped an Occupy Boston organizer and stole her iPhone - after yelling at her and other women occupiers that they were prostitutes.

Brian D'Amico, who watched the arrest, reports that in addition to Occupy Boston participants chasing the guy after the theft, a number of photographers took off in pursuit as well. The Phoenix's Chris Faraone, on scene as well, blogged about the incident at the time.

Just curious, but nowhere in the article does it really show the accused is a FAM, just that he works for TSA. Of course, if he is a FAM, that's probably exactly what it would say, but there are lot's of people who work for TSA that aren't FAM's.
It says she went to their headquarters in Boston, but the FAM's aren't actually headquartered in Boston.

Assault and battery would be a "lesser and included offense". The more serious crime is the unarmed robbery. Assault and battery is a misdemeanor vs. unarmed robbery which is a felony.

all that quietly, though I can't be sure. Looks like he may have been actively resisting arrest, from posture in photo.

Honestly,

Nothing can be inferred from that picture about resisting arrest, it appears that the pat frisk is being conducted. Furthermore, the video shows him being followed and bumped twice as he tries to walk away.

The specific charges could also have something to do with the fact that the witnesses and victims refused to identify themselves (according to the police report).
