It's time to Stop & Sue drug companies for alleged anti-trust violations

Ahold, USA, the Quincy-based parent of Stop & Shop, is suing the maker of a popular anti-acne drug, charging it's conspired to keep prices up by buying off competitors and filing bogus paperwork to stall federal approval of generic competitors.

In its suit, filed yesterday in US District Court, Ahold alleges that Medicis Pharmaceutical Corp., which makes the oral antibiotic Solodyn paid one generic manufacturer $55 million to put off its plans for a generic equivalent for several years and that the company filed sham lawsuits and bogus complaints with the FDA in an attempt to tie up other competitors in paperwork and regulatory action that could take years to resolve.

In addition to Medicis, the suit also names several generic manufacturers that were allegedly paid off by the company.

Ahold is seeking a stop to the practices, as long as lots of money - tripled under the provisions of federal anti-trust laws.
