Marathon bombing victim holds up prosthetic leg in face of Tsarnaev supporters

WCVB reports on the scene outside the Moakely Courthouse this morning before a hearing in the Dzhokhar Tsarnaev case:

As Marc Fucarile was entering the courthouse, he overheard Valerie Vanetta and Karin Friedemann speaking to the media about the case and their support of Tsarnaev.

Fucarile stopped, lifted his prosthetic leg and asked the supporters, "That's trickery?" before he continued into the building.

Because our constitution specifically says that "Police have the power to kill someone if they, through summary judgement, pronounce the suspect to be guilty and think the trial will be expensive".

Oh, no, wait, it says we have the right to due process concerning revocation of our liberty and lives, and suspects are presumed innocent until guilty.

But, hey, it sure FEELS GOOD to IMAGINE it from your armchair, eh?

Looks like the terrorists have won, then. We've lost all sense, reason, and belief in the things like our most basic founding laws that make this a free country. I guess that's one way for them to destroy America ... from the inside out.

I ask because I'm unfamiliar.

1) Are that saying Tsarnaev did not do the crime(s)?

2) Is Todashev part of their theory? His death is suspicious, not just because he died at home while being questioned by FBI with Mass State Police present but because the FBI kept changing the story abut what happened and most of it was leaked to the press which means they leaked it (The witness was dead.)

Little was known about the brothers, even by the FBI. They knew he was involved in the bombing and they knew he was involved in the murder of a cop. And that's about it.

To have let the police kill him in the boat would have been giving into mob justice and that's not what this country is about.

Seeing as how much money already needed to be spent caring for and cleaning up after the bombings I'm more interested in seeing the kid rot in jail for the next 60 years instead of getting a quick death by a cop with a gun or via some painless poison in the veins. Once he's convicted he'll have 60 years to dream about what he could have been and second-guess his planned eternal salvation.

A little reality in the face never hurts.

That said, why the hell is this case still in Boston? This is a small town - everyone has some connection to somebody who was involved in this, sometimes on both ends (for example: Cambridge Ringe and Latin alone is huge and anyone who went there or had kids there at the same time is out ...).

It will save enormous amounts of tax dollars if they just ship this trial somewhere else.

the trial should be in Boston. I wouldn't consider people in New York or Washington DC to truly be a jury of the suspect's peers.

As for your comment about tax dollars being wasted - there's a simple solution. Assuming there's a guilty verdict inthe case, refuse to hear any appeals except those where new evidence (i.e. not avalable at the original trial) that establishes the suspect's innocence.

Find something in our Constitution and two centuries of case law that make your proposition viable.

Otherwise, look up the Innocence Project for the reasons that appeals are necessary.

What is unnecessary is the practice of granting appeals on total BS like "the guy was proven guilty, but he claims his lawyer was incompetent". Or the total BS of "a cop in uniform can't detain a drunk driver who hit him when he's out of his jurisdiction."

ANd I firmly believe that if a person truly believes they've been wrongfully found guilty of a crime, the onus is on them to prove their innocence beyond a reasonable doubt. And that should be done with actual EVIDENCE supporting ther innocence, not bogus "inaequate representation" arguments or other legal semantics or other technicalities.

We can't just make shit up as we go along because we don't like the defendant or because someone was convicted of a heinous crime. Or because some "rationality with out reality" type thinks it makes sense.

I have no objections to appeals where exculpatory evidence establishing a persons innocence that could not be previously presented is provided in support of that appeal.

However, if a person hires a lawyer, it should be incumbent upon them to check on that lawyer's background first. And "well, the lawyer didn't think of that the first time", isn't a valid reason to give a person a do-over AFTER they were found guilty by a jury."

But let's continue on this nonsense of "innocent after proven guilty" that drives the appeals process.

(yes, public defenders have been caught sleeping during trials involving the death sentence, leading to much debate over whether that was actually fair or not. Eventually the Fifth Circuit decided that it wasn't fair, and ordered a new trial. However, they were careful to note that if your public defender is drunk, high, or suffering from Alzheimer's, but is actually sitting in the courtroom, you are in fact "represented" and thus can be sentenced to die.

People who end up stuck with a public defender don't have a choice of which lawyer they get. These are more often than not the "ineffective counsels" that end up causing appeals.

Earlier this month, Tsarnaev's lawyers argued anew that "emotionally charged" media coverage and the widespread impact of the attacks have made it impossible for him to get a fair trial in Massachusetts.

U.S. District Judge George O'Toole Jr. rejected Tsarnaev's first request in September to move the trial, ruling that Tsarnaev's lawyers had failed to show that extensive pretrial media coverage of the bombings had prejudiced the jury pool to the point that an impartial jury could not be chosen in Boston.

I do not think the O.P.'s point was that Islamic radicals are progressive so much as that the people who are supporting Tsarnaev are progressive. But to your point, that is the paradox, right? Progressives supporting a religion that would eliminate progressive values. Mark Steyn does a whole riff on this (I paraphrase) "if the Muslims take over, I'll grow my beard a little longer, my house of worship will have a dome etc, but I'll be all right....but how long will your L/G/B/T lifestyle will be allowed etc etc"

I know I shouldn't do this, but...

The weight from above collapsed on the structure below. It's called pancaking. If you watch video of the towers collapsing, you'll see no movement from below until weigh presses down from above. The reason the tower that was hit second went down first was that there was more weight being exerted downwards after the structure was compromised. I've never studied engineering, but even I can figure out that.

Although I am fully aware that there is due process in this country, and that everyone is presumed innocent until proven guilty, I just don't get this whole Tsarnaev fan club thing. And it is even more widespread than just Tsarnaev . There seems to be a whole subculture of women who have a thing for these criminal types. Marrying men in jail, etc. It's odd.
