Police knew right where to find North End attack suspect because they'd stopped him earlier in the evening for a chat

A Fall River man had bail set at $10,000 today at his arraignment on charges of assault with intent to rape and indecent assault and battery for an incident early Saturday morning, the Suffolk County District Attorney's office reports, adding he does not appear to be the man who raped and photographed a North End woman in February.

Boston Police picked up Wagner Nieto, 36, in Fall River late Saturday night.

According to the DA's office, police had stopped Nieto earlier in the night because he had been wandering around the North End in an apparent drunken state. After conducting a "field interrogation and observation" interview with him, which included getting his name and address, they let him go. Prosecutors say that after the woman reported the attack:

A canvas of the area did not turn up the suspect, but investigators obtained surveillance imagery from the area that depicted him. Officers assigned to Area A recognized him from an encounter earlier that night. ... Using the information in that report, detectives located Nieto at his home in Fall River late on Saturday night.

According to the DA's office, Nieto's victim had been walking in the area of Tileston and Wiggins streets when she realized somebody was walking right behind her.

A brief conversation ensued when she turned to acknowledge him. The man assaulted her and she struck him, at which point the man fled on foot.

Prosecutors had asked for bail of $15,000. Judge Tracey-Lee Lyons reduced that to $10,000 but ordered that Nieto wear a GPS monitoring device if he posts it.
