How can Tsarnaev get a fair trial if people keep getting reminded that he and his brother killed and maimed a lot of people here and up the street? What will the object of Jann Werner's affections do now? Oh the (in)humanity!
If Dzhokhar Tsarnaev were to be tried in state court, he'd be convicted for life without parole, not be a martyr to any other crazy ass teenager, and spend the rest of his life in obscurity in Concord or Walpole. It wouldn't matter if they wanted to send the trial out to North Adams, it'd be the same verdict, regardless.
Instead, it's a fucking circus because ~60% of the prospective jury pool don't believe in capital punishment and are therefore excluded.
This is all bullshit. Carmen Ortiz is a media-whore.
team of lawyers should be spending their time trying to get the death penalty off the table instead of focusing on this "change of venue" nonsense that two judges have already rejected.
And any lawyer who is already asking the question "does this decision give us grounds for appeal" should be immediately disbarred.
... Ortiz's office won't take it off the table. The only reason she wanted it in Federal jurisdiction is to have a capital case.
The repeated change of venue motions are stupid, I agree. I suspect that the lawyers are trying to show that there isn't a jury pool here. Alas, the pool was 3K to start, and there are roughly 2 million adult citizens in eastern Massachusetts, I think their arguments just don't hold water. And the judges keep agreeing with me.
Some don't believe in the death penalty, true. However, the real issue is that too many of us have at least a single connection, if not multiple connections, to the event, that disqualify us from being involved in the trial.
thst's a low ball figure, there's more than 2 million adults in eastern MA...the state has 6.7 million people and the vast majority of the population is in eastern MA, Greater Boston.
... who are not registered to vote and therefore not eligible for Federal jury duty.
I guesstimated 2 million adult citizens who are eligible, as a conservative number. IIRC, jury duty is optional after 65 -- though that may only be true in Florida -- and immigrants and non-resident college students will not be called.
"...should be immediately disbarred." That's pretty harsh. I guess there really are instances where everyone, including lawyers, just need to shut up and step into line.

Boston is a very large small town in that regard.

Boylston Street is Boston's main thoroughfare. I'm surprised that it wasn't plowed already. If it wasn't, I'm sure it was about to be.
