Stepmother charged with beating toddler who died

Boston Police report arresting Maria Buie, 26, of Roxbury on a charge of Assault and battery on a child for an incident at 23 Alpine St. in Roxbury on Jan. 31.

A 3-year-old was rushed to the hospital, where he died three days later. The boy's exact cause of death remains under investigation, police say.

Accompanied by her attorney, Buie turned herself in at the B-3 station around 10 a.m. today, police say.

She turned herself in, location seems pretty silly to ask about. Cuffs and booking sheets all done the same throughout the city.

Is that too offensive a word to use on uhub, even for a stepmom who beat a 3 year old boy to death?

i'm unfamiliar with the law in cases like this, what kind of sentence can we expect this foul thing to get?

Currently, the mother, or defendant is charged with AB on a child. This is not a particularly... "harsh" charge. So to answer your question directly, I believe the max penalty for this is 2.5 years in the house or 5 years in state prison.

All that being said, the charges don't really matter. For most felonies in Massachusetts, a grand jury has to approve the charges. A defendant can be charged with a more serious charge in a district court immediately, but the district court cannot actually hear/address said charge. So, in other words, the DA's office charges someone in district court in order to get bail/buy time to present evidence to a grand jury with the hope of dismissing the district court case to a superior court case which ideally (from the DA's office POV) will include more charges.

If a grand jury votes to indict this defendant, her penalty will be based on what charge is given (murder 2, manslaughter etc.) and the defendant's criminal record. In my experience, people get around 8 to 20 years for manslaughter if they plea, depending on their record.
