Court upholds life in prison for pair convicted of murdering Hyde Park couple

The Supreme Judicial Court today upheld the first-degree murder convictions of Earl Fulgiam and Michael Corbin for the 2011 double murder of Billie Marie Kee and Kevin Thomas, Jr. in their apartment at 957 Hyde Park Ave.

A Suffolk Superior Court jury convicted Fulgiam and Corbin in 2013 after hearing evidence that the two, aided by others, burst into the couple's apartment and, as her 4-year-old son slept in another room, bound Thomas's ankles with the cord from curling iron, then shot and stabbed their victims repeatedly. The motive: Robbery of Thomas, described in the decision as a "high level" drug dealer selling several thousand dollars a week of both marijuana and cocaine.

The justices ruled that investigators erred in obtaining cell-phone text messages without a warrant, saying such messages are personal property for which Constitutional search-and-seizure protections apply and dismissing the Suffolk County District Attorney's arguments that, among other things, the fact that Corbin's cell provider did not do background checks meant he had less of an expectation of privacy.

The court then considered whether this violation was so egregious that it led to the convictions and concluded it did not, because prosecutors presented other, overwhelming evidence that the two were guilty and that a jury would have convicted them even without the cell-phone data.

The decision to require a search warrant for such data should not affect future cases, because Suffolk County police have been applying for search warrants for several years now, a spokesman for the Suffolk County District Attorney's office says.

The SJC automatically reviews all "life" sentences on appeal. This is an important check on state power that also saves time and resources with multiple layers of appeals on the highest sentences.

Save any typing about "frivolous wasteful blah blah" for other things.

Adam,
I've always been a big supportor of this site and appreciate all of your articles. BUT, I am absolutely disgusted by the fact that you had to say"Hyde Park Drug Dealer" in this one. This is my first cousin, and you have no idea of how grisley their murders were, and the impact it has had on my family. Absolutely no reason for you to mention anything about drug dealing whatsoever. You say "Hyde Park Drug Dealer" in the headline, but fail to say anything in the actual article about him dealing drugs. Are you just trying to attract more people to articles by baiting them with headlines? No matter the case, very distasteful and unnecessary!!

The attached court decision has more details on that point (see footnote 19), as do media accounts at the time of the arrests. The sad fact is that it's a key part of the story - why the murders happened. But I've taken that out of the headline and added it to the story.

I don't know these people from Adam (as the saying goes), but I remember this crime. Kee was from a good family from what I remember. The original headline was pretty bad, so thanks for changing it.

Thank you for changing the headline. The whole situation was horrible, and I just didn't see a reason for you to say that. Regardless of the facts, he was still someone's son, father, brother, cousin etc...
