Court tosses heroin as evidence against men initially ordered out of car due to the odor of pot

The Massachusetts Appeals Court ruled today that heroin found in a car after the driver was pulled over for a traffic infraction can't be used as evidence against him or his passenger, because the only reason state troopers ordered the two men out was the aroma of burned pot, which by itself is no longer an indication of criminal activity in Massachusetts.

The two men were under surveillance by state troopers when they left the home of a man suspected of murder in 2009. When the driver failed to signal a turn, troopers pulled them over and, on the basis of the pot odor, ordered them out and searched the car - finding a bag of heroin in the car's center console. The two men then tried running away, but were quickly recaptured.

But for the second time this year, the court ruled that absent any other indication of criminal activity, the odor of pot is no longer enough to order somebody out of a car. The rulings come in the wake of a decision by the Supreme Judicial Court last year to toss similar evidence found after a Jamaica Plain man was pulled over and ordered out after cops smelled pot.

Prosecutors said the troopers also had "a reasonable fear for their safety" because of the link between the car and the murder suspect, but the court rejected that argument because the two men troopers saw getting into the car were white, while the suspect was dark-skinned.

The court did give prosecutors a tiny victory. The two men initially argued the stop itself was illegal because the failure to signal didn't cause any other drivers any problems. The court, however, said, sorry, you need to signal even if the traffic is only "light."

Top school officials urged employees to attend rally for their boss

At least three school officials used their city e-mail to encourage BPS employees to attend a weekend rally in support of School Superintendent Carol Johnson - under fire for the Rodney Peterson affair.

The rally came the day after a group of parents - led by parents at Boston Latin Academy and the Mission Hill K-8 School - began a petition drive seeking Johnson's ouster.

Michele Brooks, an assistant superintendent, Samuel DePina, BPS assistant chief operating officer, and Jill Carter, executive director of the BPS health and wellness department, sent mass mailings out Thursday afternoon to BPS principals and program directors, urging them to attend the rally. In her message, Brooks wrote:

On this Saturday, July 14th, at 10 am there will be a rally to show support and appreciation for Dr. Johnson. It will take place at the Bethel AME Church at 40 Walk Hill St. in Jamaica Plain.

Dr. Johnson has done much to support the engagement of families, students and the community in Boston Public School. Her commitment to engagement is evident in the Acceleration Agenda where deepening partnerships is identified was a key strategy. Her support of Parent University and FCOCs [Family and Community Outreach Coordinators] has been unwavering. I hope you'll consider joining the rally. Please invite and share the invitation with your contacts.

Carter wrote:

Dear Wellness Council members,

Roslindale youth-baseball coach charged with 'enticing' player

Jose Ortega, 41, a coach with the Boston Broncos youth baseball team, was ordered held in lieu of $50,000 bail today at his arraignment on four counts of enticement of a child under 16, one count of unnatural and lascivious acts with a child under 16, and one count of attempting to commit a crime – posing a child under 18 in a state of nudity.

All of the charges read against Ortega in West Roxbury District Court today relate to a single player he recruited for the team earlier this year, in part by claiming major-league connections, the Suffolk County District Attorney's office reports. Additional cases are now under investigation, the DA's office says.

Prosecutors are not alleging that Ortega actually touched the boy, but do charge he fondled himself in the boy's presence:

Over the weeks and months that followed [the boy's recruitment] Ortega allegedly began "grooming" the boy in phone conversations, in Facebook messages, and in person. He allegedly asked the boy to enter his van to engage in sexual activity, to come over and shower at Ortega's house, and to take sexualized photos of himself to send to Ortega.

The case first came to light when a relative of the boy observed some of the explicit messages on the boy’s Facebook account.

Short circuit sparks fire in Allston duplex

The Boston Fire Department reports one firefighter suffered heat exhaustion battling a blaze reported shortly after 7 a.m. at 100 Hooker St. in Allston.

Five residents were displaced, but none was injured, the department says. Damage was estimated at $100,000.

Three shot, two dead in car in the South End

Boston Police report officers found three men in a car shot shortly after 2 a.m. at Shawmut Avenue and Herald Street. Two were pronounced dead at the scene, the third was taken to Tufts Medical Center and is expected to survive.

Police say witnesses saw gunfire coming from a gray "SUV style motor vehicle" with Rhode Island plates.

Early morning fire does major damage to North End restaurant

The Boston Fire Department reports a one-alarm fire that broke out around 3 a.m., Sunday did an estimated $350,000 in damage to the building that houses Prezza, 24 Fleet St.

The fire, which started in some restaurant ducts, spread to the second-floor ceiling of the three-story building in which the restaurant sits. Seven residents were displaced, four firefighters required medical attention for minor injuries.
