Convicted sex offender charged with attempted rape in Mass. General women's room

Boston Police report David Flavell, 40, was arrested after allegedly attacking a woman in a hospital restroom. According to police:

Preliminary investigation, at this time, indicates that the victim was assaulted by the suspect but that no sexual assault occurred.

Flavell is scheduled for arraignment today in Boston Municipal Court on charges of assault with intent to rape and assault and battery by means of a dangerous weapon.

Flavell was convicted in 1998 of assault with intent to rape and in 2001 on two counts of open and gross lewdness and lascivious behavior, according to his record at the state Sexual Offender Registry, which lists him as a "a high risk to reoffend." In 2008, he was arrested on charges of assaulting a woman in a restroom at a Braintree bookstore. The Herald lists more charges against him.

His last listed address was 444 Harrison Ave. - the Pine Street Inn.

I tried to comment on this on boston.com but was denied due to some error. so they keep saying he gets "treatment" for these offenses, but no one mentions jail time. This person raped a 6 year old - isn't that a 25-year sentence at least? can someone in the legal system explain why this man is not in prison? This man should have never been given the chance to assault the woman at MGH - he should have been in prison! how is he legally allowed to get to this point without doing serious time? as a woman, this really infuriates me. there are people in prison right now for marijuana possession doing more time than this guy ever has.

A Boston Municipal Court judge ordered Flavell held without bail pending a hearing on Tuesday, according to the Suffolk County District Attorney's office, which says it will seek "a dangerousness hearing to have him held without bail pending his trial" on the MGH charges.

Flavell was arrested moments after the woman escaped him and fled from the women's room "bloody and screaming," DA Dan Conley said.

"It was a brazen attack and a very violent attack," Conley said in a statement. "We're using every tool at our disposal to keep this man off the streets."

He added that the woman suffered facial injuries that are serious, but not life threatening.

Channel 4 has them; attack was in a ladies' room in the hospital lobby. Also explains why a judge released him from jail two months ago - five experts said he wasn't dangerous.

the phrase "gross negligence" comes to mind, (by the judge). Sounds like someone long ago dropped any pretense of being a "public servant".

I still want to know why he's never done serious time for the rape of a 6 year old. the rape of the woman at MGH just shouldn't have happened, period.

where does it say he raped a 6 yr old boy?

I looked at his arrest history and nowhere does it say he raped a 6 yr old boy. Are you referring to Corey Saunders?
