Man who allegedly spat at T bus driver skips arraignment; bus driver who allegedly smashed his face shows up

A Boston Municipal Court judge issued an arrest warrant today for Homer Henderson, 52, of Roxbury, when he failed to show up to face a charge of assault and battery with a dangerous weapon - his spit - in an incident on a 1 bus at Mass. Ave. and Washington Street on Dec. 20, the Suffolk County District Attorney's office reports.

Terri Felix, 40, of Brockton, the driver of the bus, who allegedly followed Henderson onto the street and swung a wooden chock block at him, smashing him in the head and sending him to the hospital with a broken cheek and other injuries, was released on personal recognizance on her own charge of assault and battery with a dangerous weapon - the chock block - the DA's office reports.

Assistant District Attorney Eric Anderson told the court that Henderson was a passenger on a Route 1 bus driven by Felix on the date of the incident. Surveillance images on the bus show Henderson apparently fall asleep on board the bus and later wake. He can be seen walking to the front of the bus and engaging Felix in conversation. The conversation soon escalated to an argument, which was captured on cell phone camera by another passenger.

After the bus stopped in the area of Massachusetts Avenue and Washington Street, Henderson allegedly spat on Felix before exiting. Prosecutors said Felix retrieved a wooden chock block from a storage compartment and followed Henderson, continuing to argue with him outside the bus. Footage from a passenger’s cell phone camera allegedly shows her following Henderson down Washington Street and striking him in the head with the block, knocking him to the ground, before returning to the bus and calling MBTA Transit Police.

if I were empaneled on a jury trying this alleged crime, based on the facts in front of me, I would vote to acquit the driver. Nobody gets paid enough to put up with that kind of awfulness.

Yeah it's really gross and totally inappropriate that he spit on her but she seems like a piece of work, too. She allegedly followed Henderson onto the street and swung a wooden chock block at him, smashing him in the head and sending him to the hospital with a broken cheek and other injuries.

Really?! Really?! You really think that kind of violence is justified? She should have just called the police and let them deal with it. Drive the bus already. Rise above the insult. It's this kind of big ego/small, ignorant person behavior (I'm talking about the bus driver here) that is the cause of too many tit for tat violent episodes. It should be condemned not condoned.

The spitting? Completely inappropriate.
The response? Completely out of proportion, and no matter how much uhubbers may react to it emotionally, likely to land the perpetrator in a lot of trouble.
One kind of damage washes off; the other...

Example:

On appeal, the defendant contends that spitting on another, intentionally and without consent, does not amount to a prohibited touching under the statute.   To the contrary, we conclude that such conduct does constitute an assault and battery.

Particularly in the age of AIDS, it may not be true that "One kind of damage washes off." In fact, people with AIDS have been charged with assault with a deadly weapon for spitting on others.

That does not mean the bus driver was justified in clocking the guy with a chock, but his action was not so trivial, either.
