DA: Serial drug dealer arrested because somebody thought it odd a guy would be climbing scaffolding while holding a gun

Januario Oliveira, 31, of Dorchester, was arraigned on a variety of gun charges Friday thanks to an alert resident who called 911 Thursday afternoon.

According to the Suffolk County District Attorney's office:

Boston Police received a 911 call at approximately 5:30 p.m. Thursday from a witness who observed a man with a gun scaling scaffolding in the area of 692 Columbia Rd. Officers responding to the area of Columbia Road and Elder Street observed a person they recognized as Oliveira and a second man walking from the direction of 692 Columbia Rd. Oliveira repeatedly looked back at additional responding officers as he walked away. Officers observed that he was holding the handle of a black firearm in his right hand and a cell phone in his left hand, prosecutors said. Officer exited their vehicle and approached Oliveira on foot. They recovered a black Springfield Arms Model XD firearm from Oliveira’s waistband. The gun had an obliterated serial number and was loaded with six live rounds of ammunition in the magazine and one in the chamber.

Oliviera, who has three convictions for cocaine dealing under his belt, was charged with unlawful possession of a firearm, unlawful possession of ammunition, possession of a firearm with a defaced serial number and carrying a loaded firearm, the DA's office reports, adding if he is convicted on the gun charges, he will face higher penalties because of the prior convictions.

Prosecutors asked for $35,000 bail and home confinment should he make bail. Dorchester Municipal Court Judge Kenneth Fiandaca set bail at $25,000 and ordered Oliveira not to leave Massachusetts should he make bail.

Regarding the home confinement order, can the landlord fight for eviction? Is this guy actually a "home" owner or a legal tenant listed on a lease? I would love to know.

Ma has no cause evictions, so no fight necessary, he can just kick him out

After about 3-6 months in housing court, sure, and cafter which MA squatters rights kick in.

Not even close to reality. I'm a landlord and a past president of a civic association in Dorchestet. Even with cause (violence, drug dealing, destruction of property, non-payment of rent) it takes 6-12 months to evict. Even with a good lawyer, lots of evidence it still takes a long time to get rid of a tenant if you can at all. In the meantime the neighbors are terrorized and your property is destroyed.

If a landlord has a tenant dealing drugs out of the leased apartment -- or using the place as a 'house of ill-repute' OR as a meth lab -- the local DA can hold the landlord liable as well. It's a lousy situation.

had to hire an attorney to evict a problematic, non paying tenant. offered a months rent to move or we would proceed with eviction. fortunately she moved - but total cost was aprox 3.5 months rent.

The City's online assessment does not list him as a home owner.

This guy sounds sketchy as hell. I wonder why his bail is not higher? He seems fearless enough and not afraid of the law one bit and I would not at all be surprised if he has 35 g's of drug money lined up for such occasions. If I were the police, I would very interested in a forensics report on bullets fired from that gun, and how well they match up with any unsolved murders.
