Fireworks spark South End arrests

Boston Police report arresting a local and a New Jersey visitor on charges they were firing off fireworks around 2 this morning on West Newton Street.

Police say that when officers arrived at 233 W. Newton St., they found three spent fireworks tubes, several irate, awakened neighbors and an "open and unlocked door." Entering, police say, officers saw a man and woman on a couch "surrounded by fireworks similar to the ones that had been observed outside."

"Fireworks? No fireworks here," one of the two allegedly told officers.

Kai Zimmerman, 42, of Brunswick, NJ and Suzanne Stuhler, 31, of Boston, were charged with disturbing the peace and possession of fireworks. Stuhler was also charged with resisting arrested after she rushed into the apartment's bathroom and locked herself in, police say.

If the suspects home (door) was not open, would the officers need permission or a a warrant to enter?

What if they had observed the suspects go through the door and then close it, would they then need permission or a warrant to enter?

... thought it was gunfire. Why the hell do people set off fireworks in the middle of the night in late July? Aren't these two old enough to know better?

Also- the police report for this is rather hilarious.

So the cops opened an closed apartment door and walked right in?

Sorry, but last time I checked, that's illegal. They have no right to enter a residence without concern of a crime being committed, even if the door is unlocked.

This one will be getting dropped.

are usually considered a breach of the peace. And officers are allowed to enter without a warrant to quell a breach of the peace.

If the fireworks were over or there were other circumstances the court might throw this out. Either way, its just fireworks.

Because this is Massachusetts, and we don't want to offend the poor criminals. People were trying to sleep and called the cops during the fireworks show? What a bunch of fucking assholes! How dare they be mean to the nice people from New Jersey!

Put 'em in jail for 30 days. Teach them a fucking lesson in respect.
