Cops give law student a first-hand lesson at Allston party

Wicked Local Allston/Brighton reports on a party turned mini-melee that left three young 'uns under arrest and two cops in the hospital. One of the arrestees reportedly refused to turn her music down at 3:53 a.m. and told officers she didn't have to do anything; she is a law student.

A law student should know local noise ordinances, which I suspect she was breaking.

I don't recommend picking a fight with police, because it's a criminal offense and for other reasons beyond that.
But the editor of this story has it wrong, "Allston-Brighton crime: Yes, Grossman does have to obey the police." Citizens are required to obey lawfully-given orders, which is not the same as "obey the police."
If a policeman knocks on your front door and tells you to open it or to step out of your house, you are well within your rights to explain that you will have the conversation s/he wants to have while standing in your own home with your door shut. Thus, the policeman's order is not a lawfully given order.
Once you open your door, you have given the policeman the opportunity to claim probable cause to investigate other unlawful acts that s/he may see in progress. Police may enter through an open door into your home or apartment without permission. They may not do that through a closed door because of rights you have in your own home.
As a law student (unless she's 1 L) she should known about noise ordinances. If she didn't, they should have cited them to her after she made her defiant response.
It sounds like this escalated to conflict very quickly. Doesn't the BPD train their officers to deescalate situations as opposed to escalate them?
Both cops ended up in the hospital with back injuries. I hope they'll be ok.

Noise Ordinances
The police can tell you to turn down the stereo or end other noise that is not within the property line limits.

I have a problem with women who are rude and disingenuous. They do not have my respect. A woman who thinks that she is above the noise laws and befriends people who hit cops is not somebody that has my respect. I refer to those women as "bitch." As you frequently see, when I read of a male criminal, I call him "asshole." I'm an equal opportunity offender. I don't care what color you are, or what gender you are, or whom you worship. If you suck as a person, you suck as a person.
I don't have a problem with women who are polite and good citizens. They have my respect. If Adam posts a story about a woman saving a person's life, I'll be sure to comment about how great I think she is.

The police entered without permission! I heard it directly from one of the innocent snowflakes! Their civil rights were violated! Harrassment, that's it -- just because they're LAW STUDENTS, they're being harrassed by the same people that cried they can't sleep with their downtown windows open at night because of south street diner. They're the pricks who think the whole world revolves people who've lived in Allston for the last 25 years. Anyway, who the hell sleeps at 3:53am in this jerkwater town that isn't even New York?

Clearly these two yahoos have never seen Good Will Hunting. One of my favorite lines: "You hit a cop. You're going in."
How do you think these two schmucks would handle being in the jail with the best view in America? Sorry, but I can't pass up the chance to give a hint using another line from GWH: "You wanna piece a my ass?"
Also, a noise ordinance is not the issue here. These imbeciles have far, far bigger and more expensive problems than a civil citation for violating a city ordinance.
One more thing. Not to defend the indefensible (Ms. Grossman, you are going to have a hell of a time with the "moral fitness" portion for admission to the bar), but I am unaware of anyone who has attended law school and ever taken a class on the City of Boston's noise, or for that matter, any other ordinance (except zoning and other development related ordinances). That's generally the type of thing that you don't even hear about until you're in practice, and most lawyers in the city couldn't even tell you where to find the City's ordinances.
Therein lies the rub
The biggest flaw with law enforcement is that the cops aren't always clear on what the laws are. Unfortunately, neither are most of the citizens. The schools should teach what the laws are instead of cursive writing and cell mitosis and all the other useless garbage that was crammed into my head from age 10 until age 18.

Until the City of Boston cracks down on these "silver spoon" idiots and the landlords who rent to them, the quality of life for residents, who pay enormous real estate taxes, will continue to go down the tube. No wonder all the real Bostonians are moving out of the City, and the idiots and Yuppies are moving in. Boston's turning into New Orleans.

Renters and students are not second class citizens. Being a bad neighbor is not exclusive province of renters, students or students who come from a background of wealth.
