Shepard Fairey takes other people's work and appropriates it for himself, but if you dare create anything similar in style, or actually produce a derivative work from one of his pieces... oh man... it's ON.

His legal team will be after you in no time.

I am also sorry because my actions may distract from what should be the real focus of my case – the right to fair use so that all artists can create freely

If all artists were creating freely, this case would never have happened. It's his lack of creativity - stealing someone else's work - that got him in trouble.

Fairey is an artistic fraud? Shocking. Never saw it coming.

Apparently you did not spend good money to see his ICA exhibit. I still want a refund.

And Led Zeppelin, The Rolling Stones, and Janis Joplin are artistic frauds for ripping of Black acts for years. And Family Guy is a fraud for ripping off The Simpsons. And The Clash are artistic frauds for ripping off that Elvis Presley album cover. And Conan O'Brien is an artistic fraud for doing a late night talk show when it was Jack Parr (or whomever) that started the idea. And Coldplay are frauds for ripping of Satriani. And SNL is ripping off Laugh In or some other skit show. Etc, etc ad infinitum.

At this point, everyone is using other people's work. Examine all the stuff that you like and you're bound to find derivative works and plagiarized works. People make a big deal about the "frauds" that they dislike while conveniently ignoring the "frauds" that they do like. I say relax, enjoy the stuff you like, and let the lawyers figure it all out. Life's too short for outrage and sanctimony over trivial stuff like this.
