DA: Fenway garage suspect should never have been let out of jail
Suffolk County District Attorney Dan Conley says his office tried to keep the man charged with beating a taxi dispatcher in a botched holdup in jail when he came up for parole - on charges he murdered an oil-delivery man in cold blood as a teenager during the Blizzard of '78.
The Parole Board released Gerald Hill in September for the murder of Max Fishman, 62, who was delivering oil during the storm. At the time of the murder, Hill was on bail for another murder, committed four months earlier, when he was 14.
"He is not worthy of parole," Conley said at a press conference outside his office this afternoon, adding that in addition to the brutal nature of the Fishman murder, Hill had "numerous incidents and issues" in his 30 years in prison. He said his office opposed Hill's parole in 2006 and 2008.
His arrest comes as the US Supreme Court considers whether juveniles can be sentenced to life terms without parole. "This defendant certainly is not a poster boy for reconsidering" life terms for juveniles, Conley said.
Hill was ordered held in lieu of $1 million in Boston Municipal Court today as police continue to look for the second suspect in the armed holdup at the Boston Cab garage on Kilmarnock Street. Conley said the pair apparently planned the attack in some detail - they knew where the money was being counted in a relatively obscure garage. Conley said.
According to a police report, the two men entered the cab garage at 60 Kilmarnock shortly before 10 a.m. yesterday, went into an office where a dispatcher was sitting. The at-large suspect yelled "don't move," hit a dispatcher him in the head with his gun, then forced him to take them to the money-counting room. The two began stuffing money into bags, then got into their stolen car and found themselves blocked by a manager arriving for work. According to police, one of them pointed a gun at him and told him to get his truck out of the way.
An officer working a detail on Haviland Street heard the radio alert about the robbery and saw one of the suspects get into a cab with "two large white bags." Police stopped the cab at Charlesgate West and Commonwealth Avenue. Hill raised his gun, the cops raised theirs, then Hill lowered his weapon and was arrested.
The second supsect is described as a dark-skinned Hispanic male, about 6 feet tall. In addition to the guns, police say, the two were also armed with plenty of zip ties and ammunition.

Is apparently the only person in the Commonwealth with a fucking brain. HE KILLED TWO PEOPLE. He should have been executed long ago, but this bass-ackwards state won't let that happen.
