No longer charged with groping, oyster shucker still faces coke charge, deportation

Weimar Foronda, a.k.a. Wilmer Fernandez, had indecent assault and battery charges dropped Friday when his alleged victim failed to show up for his trial, the Suffolk County District Attorney's office reports.

Foronda, 41, was arrested for allegedly groping a waitress at Durgin-Park in 2011. The Boston Licensing Board suspended the restaurant's liquor license for two days after other waitresses testified he'd also groped them but that they never reported it because they thought that was just part of the price of working there.

Foronda, a Colombian citizen, still faces trial as an alleged cocaine dealer. An investigation that started when he moved from Durgin-Park to the Union Oyster House culminated in his arrest last July at the Irish Famine Memorial, where he was charged with possession of 16.5 grams of cocaine, divided into several plastic bags. At the time of his arrest, ICE requested he be held in jail for allegedly being in the country illegally.
