The Massachusetts Appeals Court ruled today that a gun found in the pants of a suspected drug dealer in a South End alley can be used against him at his trial.
A lower-court judge had ordered the gun dismissed as evidence, saying two Boston detectives had no probable cause to frisk Enrique Cabrera on Oct. 15, 2007. The appeals court, however, said a series of events gave the detectives reason to conclude Cabrera was involved in a drug deal and that officers who feel their safety is at risk can frisk suspects for weapons even in the absence of bulges that might indicate a weapon. The judges add, though, that such cases are showing the strain between conflicting sections of the federal and state constitutions: Read more

Preston Jackson, a Mattapan man charged with continuing to rob Back Bay, South End and Fenway stores even after his photo started showing up on TV, pleaded guilty today to nine counts of armed robbery and one count each of armed assault with intent to rob and attempted robbery, the Suffolk County District Attorney's office reports.
Suffolk Superior Court Judge Peter Lauriat sentenced Jackson to 13 to 20 years in state prison.
Jackson never actually showed a weapon during his holdups, in which he typically passed a note to a clerk, but was charged with armed robbery because he told his victims he was armed. After his last, failed heist, police recovered a note on the street that read "Give me the money quietly and no one will be shot."
