Bobby Orr's daughter-in-law charged with wiretapping, drunk driving

The Patriot Ledger reports Chelsea Orr was arrested mainly for drunk driving the other night after allegedly plowing into a tree and rolling her car over, but that Cohasset police charged her with illegal wiretapping after she told them she'd recorded some officers at the hospital on her phone. She also namedropped Bobby Orr and vowed to have the arresting officer fired because she is "very powerful," police said.

Lawsuit over state wiretapping continues.

Yeah, I thought the courts said that you were allowed to tape cops while they are acting in their official duties.

What the appeals court actually ruled on in the Glik case was whether Glik could sue the police officers who arrested him. While the court did agree recording public officials in a public space is protected by the First Amendment, they did so only as far as saying that means Glik can sue, because First Amendment violations are grounds for stripping police officers of their "qualified immunity" against lawsuits over their actions while on duty.

So we'll have to wait for a ruling by the judge in the Glik case (and then, maybe, for any appeals).

In Gilk, there was a man who openely video and audiotaped the police in a very public place. Pretty clear that this is a legal thing to do.

The MA Supreme Court already ruled that secretly audiotaping the police (or anyone) is against the law, and this is what seemed to be decribed in this case.

Interesting. I had no idea that was how the law was worded. Given the police's propensity for confiscating recording devices, you'd have to announce you were recording the encounter and then have your phone/camera stream the video to the internet so that it couldn't be confiscated and 'misplaced,' but there are already apps for that, if you have a vague idea of what you're doing.

I'm still not sure why they'd charge her with the wiretapping offense rather than the much less defensible drunk-driving charge, but I can't say I agree with her taking a belligerent stand against the police when she had just drunkenly wrapped her car around a tree.

Or could be charged with both anyway. They wouldn't need to leave one of the charges out if they didn't want/need to.

driving a 2 ton SUV drunk through Cohasset at 8:30PM could've gotten someone one killed. Add to that the "Don't you know who I am?" attitude and she deserves all the ridicule one can muster.

Much agreed. As if the drinking and driving weren't enough, she threatens their jobs. Who does she think she is, is the question. Being Bobby Orr's daugher in law is cool, not powerful. Get over yourself!
