Board delays hearing on what would be Boston's first marijuana dispensary

At the request of the applicant, the Zoning Board of Appeals today deferred hearing the case for and against a medical-marijuana dispensary on Milk Street downtown until July 7.

"We've been in talks with the Mayor's office and we want to get it right," Mike Ross, attorney for Patriot Care, said this morning.

Patriot Care has a state license to sell marijuana to people with prescriptions, but also needs approval from the city zoning board. It hopes to begin operations by year's end.

The new hearing was set for 9:30 a.m. on July 7.

My first thought indeed was that the city was stalling. But then I read the story.

My second thought is to ask if Attorney Mike Ross is former City Councilor Mike Ross? Just curious.

just because the requester delayed it doesn't mean we know why they requested a delay. If they "want to get it right," as the post states, it could easily mean the city is purposely making the application process confusing, not straightforward, or hostile.

They might have received a 'friendly' call from the morally crusading mayor and decided to check all their paperwork before walking into an openly hostile process.

... people who would benefit - folks with CANCER, for instance, or AIDS patients - wait and wait and wait (or else have to illegally obtain it, putting their health at further risk should it be some souped-up trashweed.)

How many years have people been smoking pot? Do we see anyone running around with a third arm sprouting from their forehead or see ANY unbiased studies showing that cannabis consumption is WORSE than the medical issues for which it would be prescribed?

There is an interesting, little known provision of the law that can help the people you describe. They can obtain a permit to grow marijuana for themselves, from DPH, if they have a DPH certificate from a doctor about their condition.

They can also subcontract the growing out to a 'friend', who can also get a permit, but he/she can only grow for one person. Since the skills to grow marijuana are certainly out there, the state has made an interesting provision. There is even a company in Allston that specializes in training and selling supplies to the 'friends'!

That's good to know. Of course, while waiting for it to mature, and then waiting for it to cure when it's harvested, the person could die.

Thanks for the info, though. I didn't know about that provision.

Suldog, I see your point. The funny thing is, there is nothing stopping an existing unlawful grower from getting a permit for growing from a friend and supplying immediately. But only if you know someone committing unlawful acts. You're right, it's quite a system we have existent right now.

Considering the confusing and jumbled mess of regulation we have now, this scenario I described would likely stop a beat cop in her tracks. Which is what any grower would probably appreciate.

Let's not pretend there aren't other effective treatments that a clinician can prescribe now, though. And that many people with chronic wasting conditions may die anyway, regardless of what medication, marijuana or otherwise, is available.
