Convicted rapist charged with new rape wasn't on state sexual-offender list

WBZ explains why Eduardo Rodriguez, arrested for a rape in a Columbus Avenue park, wasn't on the list and talks to his former girlfriend, who says she checks the list all the time and never would have dated him had she known of his past.

There's a photo of him in a Red Sox cap, but no mention that he is of no relation to the Red Sox pitcher of the same name. How many folks will be confused by that?

...but I assume anyone familiar with the pitcher would know to look at this guy that he is not the same Eduardo Rodriguez. And even if it were the same, the headline would be "RED SOX PLAYER ACCUSED OF etc. etc. etc." Just one dusty ol' cowboy's opinion, though.

that the former girlfriend should change the place where she usually meets guys, if she has to check a sex-offender list "all the time" in order to vet someone.

Seriously, why wouldn't anyone check it? Anyone with kids, anyone dating, anyone at all.

I check it once or twice per year since there are several registered offenders within a mile of my house. I guess I like knowing their faces & their associated addresses, even knowing that people age & people relocate, fail to report, etc.

I grew up with someone that was sexually abused by her father. she was raped everyday from age 8 until she was 13 years old. when we were teenagers we were told he was in jail for taking part in a violent fight where someone was seriously injured. anyway, I didn't find out until years later that he was in prison for raping my friend everyday after work. my friend died last year from drugs and alcohol abuse. I attended her services and watched her father (still with the mother) stand next to the casket and accept condolence's from all who came to pay their respect. he stood next to my dead friend, the daughter he raped for years, and he cried. she had struggled with drugs and alcohol her whole life leaving behind three kids and two broken marriages. wherever she is now I guess she might finally have some peace, I certainly hope so.

now my question. the "man" who raped my friend for all those years now lives comfortably in a very nice house in Brighton, oak square, to be specific. he has at least 4 granddaughters that I'm aware of and he lives in a section of brighton that is still filled with a number of families and children. his home is very close to the ymca and the presentation school, very close.

WHY IS THIS GUY NOT LISTED AS A SEX OFFENDER?!?!?! HOW DOES A PERSON WHO RAPED A CHILD FOR YEARS GET TO LIVE QUIETLY IN A COMMUNITY FILLED WITH PEOPLE UNAWARE OF WHAT HE HAS DONE???

I have spoken to an social worker who worked with my friend way back and she told me she could not discuss it. does anyone understand how this is possible? is there a statute of limitations? this stuff all went down in the 80s-early 90s. it makes me sick.

My deepest sympathy to you for the loss of your friend, and for the pain she must have endured.

I don't think any of us can give a definitive answer to your question, but my cynical suspicion would be that he made some kind of plea bargain that didn't require him to register, presumably because he was a "good old boy".

If he completed his sentence before they went into effect, he cannot be retroactively assigned to them. This is due to rather reasonable protections against infinite piling on of additional conditions after trial and sentencing.

Do you have any public records from his trial anywhere? You might send them anonymously to the family - or to the parents of the granddaughters.
