Dorchester man gets two years for selling guns illegally

A federal judge this week sentenced Victor Florentino, 22, to two years in prison after he'd plead guilty to one count of engaging in the business of dealing with firearms without a license, the US Attorney's office reports.

Florentino was one of several dozen people arrested during a federal and local sweep of members of various local gangs on gun and drug charges in 2016.

Florentino had pleaded guilty in March, after prosecutors charged he'd brokered the sale of three handguns, one with an obliterated serial number.

Florintino pleaded for a sentence of no more than a year, in part because he grew up without a "positive father mentoring figure" in his life; that, in fact, he watched his father beat his mother regularly. Also, a short sentence would let him get back to caring for his mother, who has terminal brain cancer.

Federal prosecutors in turn asked for a three-year sentence, charging the evidence showed Florentino "had substantial ties to illegal firearm trafficking," and that he has a record of other crimes involving violence and drug trafficking:

Defendant had opportunities to change his lifestyle based on his involvement with the criminal justice system. He chose to continue to commit crimes, and, in this case, to arm other criminals.

Only 2 years for illegal trafficking to gang members. Meanwhile Healey threatens to lock up licensed gun owners for 10 years if they violate her monthly 'reinterpretations' of MGLs via FAQ.

No wonder criminals keep committing crime without a care in the world. They know the state is more interested in harassing people interested in trying to obey the law rather than prosecuting those which ignore it. So much harder to put real criminals behind bars than to extort a plea deal out of John or Jane Q. Public whom has everything to lose.

I'm legal, with an LTC for the last sixteen months. As part of that process, I've gone through at least three background checks, did almost 40 hours of training/education, produced an application and letters of recommendation to my local PD, was fingerprinted and have paid fees for application and training that totaled out at about $500. I've bought two shotguns, and in both cases have gone through an authorized FFL, and more background checks for each gun.

In other words, I did everything legally and spent a huge amount of effort and money to play by the book.

And this clown gets 24 months for illegal possession, multiple illegal sales, and obliteration of a serial number?

Hey, Maura Healey, stop punishing people like me and start punishing guys like this!

Things are definitely upside down when penalties for this clown's crimes (even if he got the recommended 3 yrs) are compared to the laws that legal gun permit holders are expected to know and follow.

Maura Healy and Mass Legislature have things severely backwards.

Funny how you can face 5-10 for crossing the state line with a non-neutered, even empty magazine while people who traffic arms play get a slap on the wrist. The reason Mass gun laws "work" so well is because they only affect the population of citizens most likely to actually follow them.
