Man already charged with one murder now charged with a second, in Roxbury

Two men were indicted yesterday for the Feb. 4, 2016 murder of Marquis Waithe on Brookledge Road in Roxbury, the Suffolk County District Attorney's office reports.

One of the two, Jonathan Aguasvivas, 24, was already behind bars without bail on charges he and two other men gunned down Raekwon Brown outside Burke High School four months after Waithe's murder. Even before the two murders, Aguasvivas had a long record - he was formally known as an armed career criminal by the time he turned 18.

Also indicted for Waithe's death: Calvin Boykins, 25, who was arrested yesterday.

According to the DA's office, Aguasvivas actually fired the gun that killed Waithe; Boykins was also charged with murder for his alleged role in setting up the murder:

Evidence developed by Boston Police homicide detectives on the street and Suffolk prosecutors behind the closed doors of the grand jury suggests that the defendants traveled together to the area of Brookledge Street, where Boykins assisted Aguasvivas in passing through a building to a parking lot. There, Aguasvivas produced a handgun and fired at a group near 55 Brookledge St., striking Waithe and causing fatal injuries. Boykins is charged with murder under the theory of joint venture for allegedly assisting Aguasvivas in the homicide and sharing his intent.

This is the second time in two weeks a local man awaiting trial for one murder was charged with another murder.
