Biden nominates acting US Attorney to take the job more permanently

The White House announced today that President Biden is nominating Joshua Levy to become the permanent US Attorney for Massachusetts.
Levy has served as acting US Attorney since Rachel Rollins resigned in May after news broke of the ways she tried to use her office to help get Ricardo Arroyo elected to replace her as Suffolk County district attorney.
Levy had served as an assistant US Attorney in Boston between 1997 and 2004. He returned to the post in 2021 after a stint at Ropes & Gray in Boston.

Can the nomination get through the Senate judicary committee?
With Dianne Feinstein dead, the committee is split 50/50 between the parties, and the Republicans won't allow any new Democrat to replace Feinstein.
In case of tie...
the VP gets to vote. She's a Democrat (of course), so it's 51/50 in the Senate.

Since he's already Acting in the role, the permanent appointment wouldn't change much (if anything) day to day. If he was coming in from the outside, he'd be sidelined until the appointment is confirmed but in this case it won't make much difference if the Senate sits on it.
