Boston man charged wth threatening, stalking Middlesex County judge

A Suffolk County grand jury has indicted Jay Korff, 54, on charges he did more than just hold a grudge against the judge across the river who oversaw his divorce case - he allegedly hacked into the judge's e-mail system and placed numerous "alarming" phone calls to him and his family members.

Korff, a financial adviser at Morgan Stanley, will be arraigned July 23 on two counts of stalking, three counts of making threats, four counts of making annoying phone calls and one count of unauthorized access of a computer, according to the Middlesex County District Attorney's office, which is actually heading up the prosecution. Korff was indicted in Suffolk County because the bulk of his alleged activities took place there.

The DA's office charges Korff grew angry with Middlesex Probate Judge Spencer Kagan after the judge ruled against him in his divorce in 2002.

Kagan ruled Korff owed his wife alimony based on his average annual salary of more than $900,000 over a five-year period. Kagan's ruling was eventually overturned by the Massachusetts Appeals Court, which ruled that even though Korff pulled a nice little stunt in filing for divorce and then not telling his wife for several months, Kagan had no right to change the couple's written agreement that alimony be based on his salary each year - which at the time was as low as $500,000 and as high as $1.6 million.

The DA's office says that was not enough for Korff:

In March 2007, the victim had difficulty accessing his email due to his password being changed without his knowledge. Sometime after this unauthorized access of his computer, several different people from the victim’s address book received e-mails linking to derogatory comments about the victim.

In an online posting last year, Korff vented against Kagan, accusing him of being a thieving Communist Lothario.

According to the DA's office, many of the harassing calls to the judge and his family were traced to an AT&T TracFone. A search of Korff's apartment found an AT&T TracFone with a serial number matching that linked to the calls - along with recordings of some of the messages to the judge and his family and files with photos of the judge and his family.

It is wrong for this man to take things so far with the judge. Probate courts are full of emotion and it doesn't help when judges do not apply the law in the first place.

Poor judicial behavior is pervasive in Probate courts because judge's know that most people don't have the financial means to got to appeals to overturn their (judges) abandonment of the law. Essex county MA has a judge who through a man in jail over a property dispute that was not support related. The man was paying for property from the ex-wife at a rate nearly 100k a year but couldn't come up with more due to financial issues and out of ugliness the ex brought him to court for the delta. I would think most women would love to be paid about 100k a year for doing nothing.

He was representing himself and never offered an attorney to him when she quickly ordered him arrested (violation of his civil rights) The tape of the hearing mysteriously was corrupted so could not be used to show the judges behavior. After about 20 days another Essex county probate judge released the man stating that since there was no support issue, the man should be released ASAP.

Subsequently the man filed bankruptcy and the ex took the case back in front of the original judge who wants the man to pay money from this retirement account (clear violation of ERISA Law) and refuses to indicate what funds the defendant has that can be used to pay (again not for support) but for the property he purchased from his ex-wife, which he was paying her nearly 100k a year.

You know, maybe if probate judges took the time to make lawful rulings in the first place their courts wouldn't be so full.

Hey may well do time, he is charged with not only stalking, but threats & harrassment in violation of a restraining order. The thing that gets me is why did he have to turn his vitriol towards the Judge's family members as well, who have nothing to do with this dispute? That is wholly unacceptable not to mention creepy.

This Judge broke the law and had direct conflicts of interest, in my opinion, from what I have read. The Family Courts are broken. Jay is innocent until proven guilty like everyone else. The Probate Courts and practices such as this Judge should be audited by the Commonwealth of Massachusetts.

This judge is the most appealed in Massachusetts. That speaks volumes right there. There's a school of thought amongst the attorneys that practice in front of him that he's just a buffoon -- both arrogant and incompetent. I have altogether too much personal experience with him and I'd go farther. I think he's probably dirty. From what I've seen it looks like a discrete quid pro quo or a personal connection of some sort will get you the verdict you want -- equity, statutes and case law be damned. The profoundly disappointing thing is that the Appeals Court usually finds a way to uphold him. It’s plenty frustrating, I can attest to that. Maybe if the Appeals Court would find the moral fortitude to slap him down every time he was wrong (which has been a LOT), he would start to straighten up. As it is, he’s a bad apple and he's spoiling the whole barrel.

Word is that he was appointed as a favor to a big Cellucci contributor. However he got on the bench, he was a real mistake and should be taken off. One things for sure, whatever his motivation, he's not afraid to ruin lives. He's got at least one suicide to his credit. If you're going to probate & family court in Middlesex – or anywhere else he might sit – if you’re not a friend of a friend or don’t want to have to buy your verdict, steer clear at all costs.

If Korff was going after his family, that was wrong. On the other hand, if the judge had conducted himself fairly and properly to begin with, I highly doubt Korff would have been angered so deeply and profoundly that he eventually strayed out of bounds.

You obviously have a dog in this fight and are therefore missing the entire point with your subjective rant. Regardless of any judge's ruling, as an attorney yourself, you must realize that in EVERY case, civil or criminal, one side will always be disappointed in the ruling, especially in a domestic setting. That is why the Appeals court exists. In the instant matter, the appeals court ruled in favor of the stalker. Nonetheless, that wasn't enough for him. He continued to harass and threaten AFTER he was made whole again and received the ruling he fought for. Are you sanctioning threatening judges, threatening their family, their wives, daughters, and grandchildren all over a ruling simply involving $$. Not FREEDOM, NOT even CUSTODY. Think about that. Now this guy has lost the respect of the entire financial community which he dedicated his whole career to establish and a heck of a lot more. Vigilante justice is against the law for good reasons - I hope you are not advising your clients to act in concert with this lunatic. You should be ashamed.

oh if only you knew of what you speak. Kagan is so corrupt, vile, and out of tune with the law and basic right and wrong you have no idea how he has driven many to the brink of sanity, and destroyed lives and families with wreckless abandon. The guy is evil reincarnated and what he does is against the law, but he is the law, so you're all screwed unless you're connected or pay. As far as coming out whole - ain't nobody who goes before Kagan that ever comes out close to whole. The man should be removed from the bench immediately, and yes, he started his career by lieing on his application to be a judge. nuff said.
