Giving doorman a blowjob no guarantee of readmission to the concert you've just been kicked out of

A Royale employee's apparent indiscretion in dealing with a woman who really, really wanted to get back into a concert there on Jan. 18 earned the Theater District club a trip to the Boston Licensing Board to explain itself this morning.

Police say the woman, attending an 18+ show that night, told officers she was being escorted out of the club on Tremont Street for being too rowdy when a doorman suggested that if she "performed oral sex on him," he'd slip her back in.

The employee insisted to police no such offer had been made, let alone fulfilled, but police Lt. Stephen Meade today gave the licensing board photos from the nearby Marriott showing the employee and the woman entering the men's room there - and spending four minutes inside, along with an unidentified second man. "They then leave from the men's room and walk in the direction of Royale," Meade said.

A District A-1 sergeant and officer told the board their investigation - which included a detective from the sexual-assault unit - showed no force or coercion, that the woman freely told them she agreed to blow the guy in exchange for readmission. They added she appeared "very intoxicated," but that she repeatedly declined their offers to file an assault complaint or get her medical attention.

Unfortunately for the woman and the worker, manager Brig Dauber met them in the lobby and wouldn't let her go back inside.

Dauber testified that when he refused to let her back in, she got irate and said she was owed readmission because of the oral service she'd just provided the worker. "You need to let me in the concert right now," he recalled her telling him. Dauber said that several of her friends joined in and began demanding she be let back in. Dauber, however, said he held his ground and called 911 as soon as the woman began talking about the trip to the Marriott men's room.

Dauber said the worker, who did not attend the hearing, left Royale's employ of his own accord not long after the incident.

The board decides Thursday what action, if any, to take.

If he took her to a back room and threatened her with arrest if she didn't do the deed, it wouldn't be amusing.

She wasn't passed out, either, and had to, um, willingly play an active role. She also could have just walked away.

Most of the times, licensing hearings involving bar patrons making serious accusations become basic he-said/she-said sessions; if nothing else, I give board members credit for having to deal with these week after week.

This hearing was basically going that same way: Police report said woman claimed to have agreed to give oral sex; police report said worker denied ever asking for it. Who the hell knows who was telling the truth - especially since neither party attended?

And then Meade, the lieutenant, pulls out these photos from the surveillance video at the Marriott and explains just what they show. You could almost hear the jaws dropping in the room. It was quite something.

Not attending the hearing was probably one of the better decisions either party ever made.

Incidentally, since those photos were introduced at a licensing hearing - rather than as evidence in a criminal investigation - are they now in the public record? I don't think that I would like to be related (particularly as a parent) to either of these folks just now.

Finally, it must have been a quite a thing to hear what her "friends" might have been saying in an effort to convince the manager to let her back in. Can you imagine being a passerby and stumbling onto that scene? I suspect that some of those passersby have been telling their story to anyone who will listen.

What if both were intoxicated? Do you measure intoxication level or maturity?

in massachusetts, either a male or female can be deemed to be incapable of consent due to intoxication. which means of course men can be victims of women.

when both parties are drunk, it becomes a little murkier. the case laws about sexual assault and intoxication generally require that the victim was so intoxicated that they were incapable of consent AND that there is a reasonable expectation that the perpetrator was aware of, or should have been aware of, their intoxication level. if both parties are intoxicated, this second part might be tricky to prove.
