Guns, drugs seized in Dorchester raid; two arrested

Two Dorchester men were ordered held in lieu of $500,000 bail each today after police say they found nine weapons, 1,000 rounds of ammunition and 250 grams of cocaine in individually wrapped packages in a raid Tuesday morning, according to Boston Police and the Suffolk County District Attorney's office.

Estuardo Castillo-Guzman, 43, was arrested on charges of unlawful possession of ammunition and trafficking cocaine. Amilcar Castillo, 45, was charged with trafficking cocaine, following the raid at 12 Rill St. around 9:30 a.m. on Tuesday.

The DA's office reports Amilcar Castillo had a valid license for the AK-47, shotgun and seven other guns, which were found in his bedroom, but said he was also charged with three counts of improper gun storage and one count of possessing a firearm in the commission of a felony. In a statement, DA Dan Conley said:

One of these defendants had nine loaded firearms in his room, including a loaded handgun under his pillow and an unsecured AK-47 next to his bed. The other had more than 250 grams of cocaine. This is what we're referring to when we talk about the nexus of guns and drugs in Boston. The amount of firepower and narcotics in this residence is extremely disturbing, and Boston Police did an outstanding job taking them both out of circulation.

How Does one get charged with unlawful possession of ammunition, but nothing about the 9 actual guns?

But was charged with storing three of them improperly, the DA's office says. I've rewritten the post with new information from their arraignment.

It does not matter if he had a license or not. Under the current statue (MGL Ch. 269 s. 10) you cannot be charged with unlawful possession if the firearms are present in your residence or place of business.

Section 10. (a) Whoever, except as provided or exempted by statute, knowingly has in his possession; or knowingly has under his control in a vehicle; a firearm, loaded or unloaded, as defined in section one hundred and twenty-one of chapter one hundred and forty without either:

(1) being present in or on his residence or place of business; or

(2) having in effect a license to carry firearms issued under section one hundred and thirty-one of chapter one hundred and forty; or

(3) having in effect a license to carry firearms issued under section one hundred and thirty-one F of chapter one hundred and forty; or

(4) having complied with the provisions of sections one hundred and twenty-nine C and one hundred and thirty-one G of chapter one hundred and forty; or

(5) having complied as to possession of an air rifle or BB gun with the requirements imposed by section twelve B; and whoever knowingly has in his possession; or knowingly has under control in a vehicle; a rifle or shotgun, loaded or unloaded, without either:

(1) being present in or on his residence or place of business; or

(2) having in effect a license to carry firearms issued under section one hundred and thirty-one of chapter one hundred and forty; or

(3) having in effect a license to carry firearms issued under section one hundred and thirty-one F of chapter one hundred and forty; or

(4) having in effect a firearms identification card issued under section one hundred and twenty-nine B of chapter one hundred and forty; or

(5) having complied with the requirements imposed by section one hundred and twenty-nine C of chapter one hundred and forty upon ownership or possession of rifles and shotguns; or

(6) having complied as to possession of an air rifle or BB gun with the requirements imposed by section twelve B; shall be punished by imprisonment in the state prison for not less than two and one-half years nor more than five years, or for not less than 18 months nor more than two and one-half years in a jail or house of correction. The sentence imposed on such person shall not be reduced to less than 18 months, nor suspended, nor shall any person convicted under this subsection be eligible for probation, parole, work release, or furlough or receive any deduction from his sentence for good conduct until he shall have served 18 months of such sentence; provided, however, that the commissioner of correction may on the recommendation of the warden, superintendent, or other person in charge of a correctional institution, grant to an offender committed under this subsection a temporary release in the custody of an officer of such institution for the following purposes only: to attend the funeral of a relative; to visit a critically ill relative; or to obtain emergency medical or psychiatric service unavailable at said institution. Prosecutions commenced under this subsection shall neither be continued without a finding nor placed on file.

No person having in effect a license to carry firearms for any purpose, issued under section one hundred and thirty-one or section one hundred and thirty-one F of chapter one hundred and forty shall be deemed to be in violation of this section.

Not to be overly pedantic, but were the guns and ammunition packaged with the cocaine for sale? That's a scary valu pak.

Great Job BPD. I am happyto see these drugs off the street, but more importantly - the ILLEGAL guns that our residents should be most concerned about. Lets continue to focus on getting these ILLEGAL weapons off the street and punish to the full extent off the law. Heck, under Bartley Fox, these punks should be going away for at least a year right?..... Read the article carefully. Strangely, they were purchased legally (which is not what I would expect from a coke dealer). Doesn't mean he's not a straw purchaser though. But he did have a license to own all 9 guns. The headline of the Globe article is misleading.

assume the dealer came from 4360 Washington Street Roslindale, MA 02131. It a drug house, mostly users! The place has multiple illegal apartments in both the basement and in the garage in the back! If i was to guess i would say the property probably has about 25 individuals living there!

This drug dealer was LEGALLY in the posession of an AK-47 and eight other guns? What is wrong with our country? Crack pots and fringe groups who think they should be able to "defend" themselves against an armed government have so throughly dominated the gun laws in this country that there simply might as well not be any laws at all. It is time for common sense gun laws that aren't based on the preposterous notion that the 2d amendment is intended to protect the right to military action. Lets have gun laws for the people, not for the nuts.
