Gun battle erupts near Roxbury playground filled with kids; one arrest made

Update: Leary ordered held in jail for at least 90 days.

Boston Police report two guys with guns exchanged at least 14 rounds behind the Trotter School on Humboldt Avenue around 5 p.m. on Sunday.

Fortunately for them they were terrible shots - and luckily for the children and parents at the Trotter playground, nobody was hit, or, at least, nobody showed up at area emergency rooms with fresh gunshot wounds, police report.

Police say officers on patrol heard the gunfire and arrived just in time to see somebody whom they already knew brandishing a firearm:

The individual fled on Hollander Street, and a foot chase ensued. Officers pursued the suspect from Hollander to Harrishoff Street, where they observed the suspect discard the firearm. In short time, officers were able to find the suspect hiding under a motor vehicle parked on Harrishoff Street. Officers apprehended the male and recovered a .380 caliber firearm in a yard adjacent to Harrishoff Street.

Semaj Leary of Dorchester, 20, was charged with unlawful possession of a firearm, discharging a firearm within 500 feet of a dwelling, discharging a firearm on school property, unlawfully carrying a loaded firearm (second and subsequent) and unlawful possession of ammunition. He was also charged with being a level II armed career criminal, which automatically lengthens any sentence he gets if he's convicted. He also had prior warrants, police say.

After listening to a recording of the gunfire on the BPD ShotSpotter system, police determined two guns were fired; a search of the Trotter School playground found a second, 9mm, gun. Police add:

Although no victims were located at the time of the incident, this exchange of gunfire interrupted what was a beautiful spring day in Trotter Park where several children had been playing.

Innocent, etc.

Second and subsequent offense....guy is out on the streets letting off shots at a school. Why is this a recurring theme every time someone's caught with a gun? Yet Evans is keeping us "safe" by ensuring that clean-record citizens can't have unrestricted firearms licenses.

For a state that's so tough on guns, we really have a joke of a court system. The revolving door isn't fair to citizens out minding their business, and it certainly isn't fair to the police who already did their job.

The police back strong gun restrictions, so you should edit your post to say its not fair to police that the NRA buys looser gun laws that result in more guns and more violence, and more cops and citizens being murdered.

who routinely snub prosecution recommendations for bail and sentencing, and don't even have to provide justification for their actions on the public record.

Except right to the immediate north of MA is a state with, not just "loose," but almost no gun laws (and we're working on repealing the conceal-carry license requirement altogether this year), and virtually no violent crime.

VT is one of the most unrestricted states in the US regarding gun laws and open carry. I purchased my Remington Versa 12g last year at a gas station, though i leave it in VT because i have no need for it in Boston. They're the original Constitution Carry state.

Shockingly MA is legally an open carry state for handguns. But no one does it outside of rural western MA anymore because licensing authorities frown on it and would pull a license over such a display in a heartbeat.

Does Vermont have a major city the size and density that Massachusetts has? Does By the same token does MS-13 have a branch in the Northeast Kingdom where they terrorize the cows?

On the other hand part of me thinks to go ahead and virtually declare open season for anyone who wants to carry a gun. The worst that would happen is that a lot of people would die. It's just death afterall and we all will depart from this world sooner or later. If it resulted in less deaths then an ironic solution of how to decrease death by gangs owning guns would be discovered.

But anyone who advocates open gun ownershp is obligated, has a responsibility to personally accept the risk of dying by gun. Openness to the risk of quicker trips to the Pearly Gates for many people requires some skin in the game.

All those laws completely banning drugs are working so well that there are no more drug dealers or drug related violence anywhere.

Who's the victim if someone uses or sells a little marijuana?

up

Drug use is not a victimless crime. And marijuana is not a harmless drug. Think about kids whose parents are addicts..... kids whose classmates are disruptive and unable to focus or learn .... teachers whose best efforts fall short because children are damaged by their parents' drug use, or their own drug use .... the social and economic cost of a generation on disability benefits because of drug use.... and lots more. Sorry to be grumpy about this, but you asked. Oh, and not to mention gun battles on the streets.

Did you copy this from your DARE book?

You do realize that legalizing weed cuts the risk of death from opiate use? Maybe not, because it is pretty clear that you don't read the medical literature (much of which is actually open access these days).

http://www.newsweek.com/states-medical-marijuana-painkiller-deaths-drop-...

And, of course, a scientific ranking of drug dangerousness (compiled by drug experts and law enforcement experts): http://www.economist.com/blogs/dailychart/2010/11/drugs_cause_most_harm

Maybe the problem is too much moralizing and ranting, not enough scientifically informed decisionmaking about drugs? Hmmm.

Oh ... and the whole "crack baby" thing has also been scientifically demonstrated to be completely bogus. http://www.nytimes.com/2013/05/20/booming/revisiting-the-crack-babies-ep...

Sure, marijuana is less dangerous than many other drugs. And these comments were written quickly, in response to the overall sentiment about legalizing drugs in general as well as the comment about a little marijuana.

But still -- marijuana use is often correlated with personality change and learning problems. It is hard for scientific studies to separate the effects of drug use from any underlying mental health or other issues. So yes, studies are inconclusive.. But still, it's common to see, in real life, the personality and behavior effects of heavy marijuana use.

Right now it is fashionable to suggest that anyone against legalizing drugs is ignorant. But maybe it would be smarter for legalization advocates to slow down and examine all sides of the issue before rushing to legalization policies that could create a lot of harm.

But still -- marijuana use is often correlated with personality change and learning problems.

Care to supply the citations for this? I know there were some poorly designed studies that have been debunked and/or not confirmed (such as that MRI study from that failed to distinguish between pre-existing brain differences predisposing people to self-medication versus differences attributable to drug use).

Sometimes correlation means causation ... and sometimes that correlation works opposite of what people want to think. In other words, there are some studies that imply that heavy weed use causes personality changes and learning problems, but I've yet to see one that successfully evaluates the realistic possibility that the learning and personality issues CAUSE the heavy pot use.

Drug *addiction* is indeed a social plague, which we could solve overnight with decriminalization and a social safety net that lets addicts get treatment. Drug *use* is a completely different story.

kids whose classmates are disruptive and unable to focus or learn

Ah, you must mean the kids who are heavily medicated with prescription amphetamines every day. But those are OK, because Reasons.

Perhaps nobody. But a lot of drugs come from places with less than stellar human rights [violators being criminals and governments alike]. You want to be careful who you are supporting with your purchases.

I believe 75% of the shootings that occur in the City are all within 1/2 mile within blue hill ave. (unsure for other crimes) I can certainly guarantee that majority of these shootings are result of drug transactions gone bad. Hopefully these youngins can wake up and be grateful for what they have instead of chasing the almighty dollar and end up dead or in jail.
