MBTA cop indicted for allegedly beating and pepper spraying woman at Dudley T stop, then lying about it

Jennifer Garvey, already facing a lawsuit for the way she handled a woman complaining about her treatment of an elderly person at Dudley station, now faces criminal charges of causing injury while violating a person’s civil rights, assault and battery with a dangerous weapon and assault and battery, and two counts of filing a false report on the incident, the Suffolk County District Attorney's office reports.

Garvey, 33, is scheduled for arraignment on Wednesday in Suffolk Superior Court in connection with the March 26, 2014 incident, following her indictment by a Suffolk County grand jury, the DA's office says.

In a lawsuit filed last year, Mary Celeste Holmes of Roxbury charged Garvey and other officers beat her with a baton and pepper sprayed her when she objected to the way Garvey was allegedly screaming at and manhandling an elderly woman at the bus station.

In a statement on the Dudley indictment, DA Dan Conley said:

We allege that the use of force in this case was unnecessary, excessive, and violated the victim’s civil rights. She was assaulted, arrested, and wrongly charged. After assessing the evidence, we determined that the only appropriate course of action was to affirmatively terminate the prosecution of her case and instead investigate the circumstances of her arrest. The vast majority of police officers in Boston and Suffolk County use their authority to protect the public and serve the community, but when the use of force rises to criminal conduct it must be charged and prosecuted.

Garvey is also facing charges separately that she pointed a gun at her wife - also a T cop - and then assaulted somebody at a country-music festival in Foxborough.

If no charges were going forward, she'd be getting her internal discipline, probably up to firing. However, since this is now part of a legal proceeding, she remains suspended with pay.

It's due process as part of employment law. Hate the game, but those are the rules.

Because of union contracts they probably had their hand tied, similar to the T Bus Driver who all lied about having their GEDs but remained on the job.

The T has known about her problems for awhile. You should look into her false accusations of domestic violence that got a state trooper suspended.

If she pointed a gun at her wife I hate to see what she did if you didn't pay your fare.
