The woman struck by a car in Roslindale died; motorist faces charges

The pedestrian hit by a car on Washington Street near Blue Ledge Drive around 4:30 p.m. yesterday has died, the Suffolk County District Attorney's office reports.

Silvia Acosta was 78.

Jaidys Pimental-Pena, 24, had bail set at $1,000 at her arraignment in West Roxbury Municipal Court today on charges of motor vehicle homicide by reckless operation and leaving the scene of an accident causing personal injury or death, the DA's office says, adding Judge Mary Ann Driscoll ordered her not to drive while her case is pending.

According to the DA's office:

Witnesses told police that Acosta was crossing Washington Street on a crosswalk when she was struck by a vehicle that then fled the area. An investigation revealed that the driver of the vehicle was Pimental-Pena, prosecutors said.

Pimental-Pena later returned to the location where the victim was fatally struck. During a post-Miranda interview with police, she allegedly made statements admitting that she was aware she had struck a person but did not stop.

Police secured the gray 1999 Pontiac sedan believed to be involved in the crash.

With all sincerity, we don't usually see homicide charges resulting from car-pedestrian "accidents" "collisions" etc.

What was different here that led to the charges? Was it the temporary departure from the scene?

Some lady hit and killed a person in a crosswalk in the South End a few weeks ago. No charges filed.

I think "leaving the scene" is a separate charge that they could apply if needed. Agreed that homicide charges are unusual. It's likely going to be because of some sort of additional circumstances. I'm thinking something along the lines of:

  • witness reporting super fast or aggressive driving
  • crossing the yellow lines to veer around a bus etc. in a no passing zone
  • impaired driver, with OUI charges next?
  • blowing a red light or stop sign
  • gross violation of hands-free law? Texting/talking while gulping down a burger or whatever

It's a hit and run resulting in a vehicle homicide. If you hit another car what do you do? You stop right? My grandmother was a very cautions woman and wouldn't have crossed if it wasn't safe. It was still light out! How do you not see her! HOW!?

Listening to the scanner BPD located the vehicle with driver, and a passenger, elsewhere. Morton Street I believe. How is that considered returning to the scene?

I based that one sentence on what I heard on the scanner, which is that the driver agreed to return to the scene.

I think you are confusing this accident with the one in Dorchester (also on Washington street) -- media reports from that one indicated the driver left the scene and was stopped at Morton Street.

Shes is a person that she is very couscous driving she has two little kids and shes always see what she does. Something must of happen for she can cause this accident.. shes is a very lovely person if you guys don't know the fact you should not comment on them... you should comment on people that are drunk drivers and they don't get charge for anything. People getting kill and they person don't get charge. so don't talk if you dont know the fact you just readying what the news tell you ok

You're right, we don't have all the facts. Maybe after the trial, if there is one, we will. But regardless of what actually happened, there is one fact we do know: Somebody died yesterday.

You sound like you're connected to the defendant. If there's going to be a criminal trial, you probably shouldn't say anything about the case in public. You can't know what the State might try to use against her.

Drunk or not. How do you not see someone in front of you please tell me? She caused the biggest pain to my family. Why would you leave her laying in the street? She saw the purse on the floor she could have called someone else to pick up her kids, she had absolutely no reason to leave.

Daylight is shorter and dimmer yet pedestrians continue to dress in all dark colors with no reflective features.

Artificial electric light has barely been around more than a century while millions of years of evolution ingrains instinct that "I can see them, they should see me". That fails when a vehicle has lights and reflectors and pedestrians don't. Guess what? Drivers actually can't see you in all dark clothing at night or dawn/dusk.

As with the Tremont Street crash, I have to ask: Were you there? How do you know what she was wearing? And regardless of what she was wearing, a) She was in a crosswalk, b) According to the DA's office, the other woman knew she hit her and drove off anyway.

Probably more to do with the miserable state of the sidewalks than anything else. One, you're constantly walking out into the street to get around snow piles or ice patches, and two, a lot more of your attention, which should be on your overall surroundings, is focused on your actual walking to make sure you don't slip and fall.

In dark, when cars have lights and reflectors and pedestrians don't, one of them might not be seen by the other. Tell us which is more likely not to be seen.

Since it sounds like the driver was on the phone instead of paying attention and the woman that was killed was in a marked crosswalk...
