Man convicted on sexual-attack charge charged with new sexual attack at Braintree garage

Transit Police report arresting Cody Chery, 21, of Randolph on a charge of indecent assault and battery for an incident at the Braintree Red Line garage on May 16.

Police say Chery went up to a woman in the garage around 5 p.m., asked her some "inappropriate questions," then "indecently assaulted" her. He then fled.

Police say officers caught up with him yesterday at the Downtown Crossing T stop, where they found he was wearing a GPS device - as part of the conditions for his release on an earlier conviction for indecent assault and battery.

Seems to be a fashion statement on the Red Line these days. If transit officers riding the train observe an individual wearing a GPS ankle bracelet can they stop and frisk the individual?

He's wearing the thing in lieu of being locked up, right? So he's being granted the privilege of being free. To get the GPS unit on his ankle, he accepts certain restrictions that would not apply to other citizens, and would in their cases be found unconstitutional. So why not put in another restriction - accept frisking on sight while having the benefit of wearing the device?

If you can be frisked at will when you're in the can, why not when you're being given a break?
