Blizzard suit swirls around W.B. Mason

Dairy Queen, which makes a concoction called a Blizzard, is suing homegrown office-supply company W.B. Mason over its Blizzard brand of bottled water, Reuters reports.

With trademarks, it all depends on the scope of the exclusivity granted to you by the USPTO:

Dairy Queen's trademark (reg 0895139) of the BLIZZARD mark is for milk shakes.

WB Mason's trademark application (s/n 87210712) is for BLIZZARD SPRING WATER.

I don't see how they overlap.

There's a brewery in MN called Schell's that used to release a "Blizzard" ale every year. On the tour, the brewery said DQ owned all beverage rights to the name Blizzard but kindly allowed them to sell the rest of their beer before renaming it (probably as a "one MN company to another" courtesy).

I should testify in this case...Ever since they replaced the water cooler at work with the one by WB Mason, I expect soft serv ice cream to be dispensed from the tap. I mean, it says Blizzard on the bottle, right there in big letters !

In the Quabbin and the Wachusett.

There is still a gas station cleaned up to the environmental standards of the 1930's (i.e. none) at the bottom of the Quabbin.

Nothing is safe, but we go on.

Truthy Lore from the Past and "has to be!!!" rumors and stories are not the same as facts.

All oil tanks gas tanks were dug out as part of demolition before the area was flooded. There and in Dana and other areas that are still above water.

Channel 5 did a thing on the Quabbin a number of years ago and showed with underwater footage old Esso oil drums in the old center of Prescott.

Also, do you really think all that creosote from the railway that went through there and all of the coal dust, was picked up? The area was denuded, but not necessarily returned to pristine condition.

That being said, the volume of water in Quabbin negates any contamination from these old sources.

(Also, when I had a really bad case of athlete's foot in 1991 I went swimming in the Quabbin after a kegger at a caretaker's house, so arrest me if you want).

Municipal water supplies are required to be tested by independent certified laboratories. Bottled water plants? Not so much.

Let me bring to light that W.B. Mason, in the early 2000s, had their own label of white copy paper called "Blizzard White". Hell, both DQ and WBMason startin to sound a little racist. Sue both their greedy asses by this third greedy ass.
