Cambridgeside Galleria shoplifters tried to escape by driving at a cop, police say

Two people face arraignment tomorrow on a charge of assault and battery with a dangerous weapon following an incident this afternoon outside the Cambridgeside Galleria.

Cambridge Police say Tiara Hunter, 23, of Dorchester, and Dominic Walker, 23, of Roxbury, stole about $1,200 worth of merchandise from a store in the mall shortly before 5:30 p.m.

Detail officers in the mall attempted to stop them, but the suspects ran from the area, entered a parked white KIA operated by Walker and then attempted to drive in the direction of a responding officer. The vehicle’s driver side mirror ultimately did make contact with an officer’s arm. The vehicle then fled onto First Street and then Hurley Street at a high rate of speed.

Police say the pair abandoned the car near Webster Avenue. Officers found and detained Hunter on Bristol Street.

Walker was later taken into custody at Webster Avenue after hopping over several fences and backyards.

Innocent, etc.

I've seen this "assault and battery with a dangerous weapon" phrasing before, and I've heard that it can include things not normally thought of as weapons, or even a skilled martial artist striking someone (no weapon as such.) What I've inferred is that it means "assault and battery in a manner likely to cause grievous injury or death" -- is that roughly accurate?

I witnessed this. These two girls are not the sharpest knives in the drawer.

Not the sharpest knives ? They can surely tell LIES as fast as they can breathe when they are cornered.

On TV one was in a guy's yard and she said...."I must be in the wrong yard." He pointed toward the gate. She jumped over the fence !

The other one jumped a fence and went into someone's house. The owner asked what she was doing there ? She said she had a fight with her sister and.........blah, blah, blah.

One comes from Roxbury and the other Dorchester. Tiara & Dominique ??? They were driving a White Car with Maine plates ? Hmmm, do you think it might be STOLEN ?

Just because they’re names are Dominique and Tiara and they are from urban parts of Boston does not mean the car is stolen. Have you ever heard of a rental? Is she not welcomed at that mall because of where she lives? I used to work security at the Cambridge side galleria mall I am a black male from Roxbury. I wasn’t the only person employed there that lives in Roxbury or Dorchester. If you are familiar with the mall on level 3 there is a store called spiced and that is owned by black men from mattapan. Just because we live in a different neighborhood than you does not mean we aren’t allowed to shop there. These two females happen to be friends of mine, they made a mistake and they will deal with the consequences but they were just trying to feed there children just like you do. That does not justify there actions but before you go judging them judge yourself. You’ll ask why don’t they get jobs but where I’m from is easier to get a gun and pack of drugs than to get a interview. So unless you great people are going to help change that don’t judge us for breaking the law to feed our families. By the way did any of you ask why a cop would stand in the way of a moving vehicle? Did he think he was a speed bump or did he want paid time off or something?

Pretty interesting to see how the law is summarized down for a jury audience.

You need a "weapon" in order to have the ABDW charge. There are other charges you can use if a weapon is not used in an assault that would make it more serious (Assault with intent to murder, Strangulation, Aggravated Assault and Battery, Mayhem, etc). If there is serious injury, then the aggravated assault and battery would be the proper charge.

This is the standard MA case which basically says you need something other than a body part to have the ABDW charge.

Isn't the car the "dangerous weapon" in this case?

ABDW, to wit a Motor Vehicle. Been there.

Sounds like the "my fist is classified as a dangerous weapon" thing *could* be based on an overturned Louisiana court ruling... but is probably just hyperbole.
