Two women charged as Massholes for 128 slapfest

State Police report charging both women in that Rte. 128 incident on Friday that made the national news.

The younger woman, 33, from Gloucester, faces charges of assault and battery on a person 60 or older, disorderly conduct, reckless operation of a motor vehicle, stopping on a state highway and assault. The older woman, 64, from Beverly, will be summoned into court on charges of assault and battery and disorderly conduct, State Police say.

State Police also told the RMV that both women are an "immediate threat," which means they will have to explain to the RMV why they should be allowed to keep driving.

The fight took place a couple months after the last time Massachusetts motorists made the national news - in the incident with the guy hanging on the hood of the car driving down the turnpike.

We've got this silly thing in the US called "due process."

Perhaps you should consider moving to a place where the state can decide things without due process.

You live in such a place. If a cop writes you a traffic ticket, you will pay money, even if you are declared innocent in court. If you dispute the ticket, there's a $25 non-refundable fee to get a clerk to review the charge. If the clerk finds you blameless, you're still out the $25. If he doesn't and you want to have a judge look at it, that's another non-refundable fee -- $50 for that. Even if the judge finds you innocent, the cop has cost you $75. Due process? What a quaint idea.

I paid the fee, fought a contempt of cop ticket last summer, won, and got a refund check from the state Treasury.

According to the DMV, the appeal fees are non-refundable.

Can I appeal a civil violation?

Complete a "Claim of Appeal" form, which you can obtain from any clerk-magistrate's office, and submit it along with a non-refundable $25 filing fee.

That isn't an actual MA DMV site, and there was a court decision against the non-refundable fees:

Crawford v. Blue, 271 F.Supp.3d (2017)
Massachusetts' non-refundable $25 filing fee to challenge a motor vehicle ticket violates due process, and so motorists who successfully challenge their ticket before a Clerk-Magistrate are entitled to a refund of their $25 filing fee by the Registry of Motor Vehicles.

So due process is restored, and flowers rain from the sky once more.

from winning an appeal before the court decision? Was there a class action lawsuit I missed? I could definitely use $50 I spent on illegal appeals a couple years back....plus interest.

Anyone know anything about this or can provide a link? Lawyer types?

Perhaps the website is inaccurate.

...Is that it's not called "the DMV" in Massachusetts. Any website claiming accurate info with a URL like that should be taken with a big grain of salt (disclaimer at the top notwithstanding). It's probably best to go right to the source.

Adam, I am so surprised you are letting all these sexist comments be published. So it's okay to publish sexist comments? What if the women were not white? Would you have handled the comments differently for fear of being labeled racist AND sexist ?

First, there aren't many comments here that refer to the genders of the accused.

Second, here's a pro tip. If you want something published, register. Then, the bar is really lowered, until you really screw up, in which case you'd be banned.
