Schedule set for garage cinema in Jamaica Plain

Matt Shuman, who's been showing movies inside his Wenham Street garage for a few years, has posted this year's schedule for his Wenham Street Cinema. Note: The June 10 movie has yet to be set: The Cinema and City Councilor Julia Mejia are conducting a poll on whether to show "Pretty Woman," "Total Recall" or "Catch Me If You Can."

Screenings are free but are BYOP&C (Bring your own popcorn and chair).

How is this legal? Copyright law says you can't have public performance of movies and music without proper licensing. This clearly falls into this category. Even though it is free, anyone can attend.

Not trying to be 'that guy' but curious to know how this can be done? Maybe someone can explain.

For all I know, it doesn't amount to too much.

I think I've also heard of this sort of thing being done with no advance notice of *what* will be playing; apparently that circumvents some of the restrictions. But whether or not that's true, it wouldn't seem to apply here.

Or, like the other commenter said, no one has snitched.

I'm pretty sure the studios who own the rights to these movies will be able to keep their heads above water even though somebody is projecting them onto their garage. This post is giving me heavy MPAA vibes. Come on, man.

if all of the listed city officials would have agreed to participate without being assured there was a PPR license secured already for each of the films, or some other fair-use-ish workaround, since all of them are shown with prior commentary.

Regardless, I think this falls into the gray area where if no one at all is making any money off of it, the MIAA isn't going to care enough to take action. It's not much different from inviting friends over to watch a DVD in your basement.

yes, that's what it effectively is. It certainly started out that way - an occasional email to the neighbors seeing if anyone wanted to get together to watch a movie or things like the presidential debate.

It's gotten a bit more formalized but that's the origin and spirit of it.

What I hate about copyright law is that much of it is deliberately vague and its application can be arbitrary. I deal with fair use questions all the damn time and the difference between a good copyright lawyer and a bad copyright lawyer is that the good lawyer knows that the answer to most of my questions is ¯\_(ツ)_/¯.

So, here's my best shot at this, from Title 17 § 101 and it could be entirely wrong:

The right to unlicensed viewing in a private residence (a garage or backyard counts) has more protections than other possible video/audio venues (schools, churches, nightclubs, etc). It's not unlimited, but the guidelines are mushy-- to wit, legally purchased or streamed copyrighted works may be shown without a separate license in the home to “a normal circle of family and its social acquaintances." What does that mean? Who knows. Does that mean "folks from my neighborhood who happen to hear about our get together?" It could mean that; the number is limited by the size of the garage, and no cover charge or ticket is required. And the law does not even provide an absolute upper-limit cap on the number of guests, just a "normal circle." Location and lack of profit is key, here-- if the same event were held at Spontaneous Celebrations or at the Haven, it would be a clear copyright violation. Ditto if a $1 door charge was applied.

My guess is that this is just straddling the fence. Adam, it might be a good idea to take this post down, just so Matt does not run afoul of the "normal circle...of social acquaintances" section.

Why even post this? What do you hope to gain by posting this inflammatory comment about a neighborhood garage gathering?
Neighbors in Forest Hills building community by getting together in a fellow neighbors garage to watch a movie and socialize isn’t remotely similar to you posting content on YouTube for the world to see (and for you to potentially profit from)

It's legal because he's not monetizing. This isn't any different from you having friends over to watch a movie in your living room.

... (at no charge) should (probably) be okay. Doing a free showing NOT at your home (say as a club event) is (alas) not -- except with permission of the rights holder.
