The Boston Licensing Board says the presence of methadone patients who aren't breaking any laws isn't reason to keep the McDonald's at Harvard and Comm. avenues from opening at 5 a.m.

Its approval means the burger/Egg McMuffin emporium can now open 21 hours a day. It previously had opened at 7 a.m., which franchisee Bob King said meant he could not serve the crowds clamoring for McDonald's take on breakfast earlier in the morning.

The Boston Licensing Board today ordered the Burger King on VFW Parkway to shut for an additional two days after a police detective found it open on the first day it was supposed to be shut as two-day punishment for staying open late without permission.

Lt. Stephen Meade told the board at a hearing Tuesday that while the dining room was closed on Aug. 27 as part of the restaurant's penance, the drive-thru continued to serve customers. Meade said he checked this by getting into the drive-through lane himself and, when he got to the ordering station, was asked for his order. He said the person behind him got served as well.

The Boston Licensing Board yesterday approved a Tasty Burger on L Street, but denied the restaurant's request to add 20 patio seats in the back.

The board, which oversees food-serving licenses in Boston, agreed with the outlet's request to stay open until 11 p.m. most nights and midnight on Fridays and Saturdays. The burger stand, which will replace the old Boat House ice-cream stand, will open at 8 a.m., with plans for breakfast burritos and coffee.

The board decides tomorrow whether a proposal by Tasty Burger to limit its hours and cut back an outdoor patio at a proposed L Street location are enough to warrant a food serving license or whether some nearby residents are right that the burger outlet would ruin the neighborhood.

McDonald's plans to seek permission to open the dining room at its Soldiers Field Road location around the clock - after learning it couldn't do so just because a franchisee felt like it.

The outlet at 1750 Soldiers Field Rd. already has permission for a 24-hour drive-thru, but was cited by police last month after a detective found the dining room open at 11:45 p.m., customers munching away inside and a large sign advertising all-night food behind the counter, even though the dining room is only licensed to stay open until 11 p.m. In addition to issuing a citation, he ordered the immediate halt to food sales inside.

UPDATE: The video has been made private (gosh, can't imagine why), so now we may never know for sure.

A security-camera company has posted a video it says shows a knife fight at "a burger place just outside of Boston." Any guesses which one? As a habitue of the Dedham Five Guys, which is just outside Boston, I can rule that one out - the layout doesn't match.

So Richard Chudy, the Boston Burger Guy, raved about the burger at the Citizen Pub on Boylston Street, finding fault only with the bun.

An outraged David A. DuBois, CEO of the Franklin Group, which owns both the pub and Tasty Burger, replied by calling Chudy an asshole and saying he'd like to meet him in person to drive the point home even more.

ChaceMBTA Transit Police report they've nabbed the guy who allegedly destroyed a $3,000 cash register at the South Station McDonald's, possibly in a snit over it being closed when he wanted to buy something.

Timothy Chace, 28, of Dorchester, was arrested on a charge of malicious destruction of property with the aid of people who recognized his photo from a wanted poster, police say.

In recent years, the chain had opened a number of its burger joints in suburbs surrounding Boston but none in the city itself.

Richard Chudy reports the burger at Clink is good, but not orgasmically, $17 good:

[T]his is very good burger, but anything that is this expensive has to be out-of-this-world. A fried egg and cheddar cheese in no way make this a luxurious burger, you end up paying for the allure of the Liberty Hotel, which is unique in its own way, but the ambiance should not dictate the price of a hamburger.

The Allston Civic Association will oppose plans by the owner of the Brighton Mills McDonald's to extend his hours until 2 a.m., the Crimson reports.

The association voted 7-6 to oppose the later hours. Members cited the precedent that letting the burger joint stay open would have and said only transients from away would be likely to eat there that late. Owner Bob King says he needs the extra hours to make up for the anticipated loss of revenue during the relocation of the nearby Charlesview Apartments.

The owner of the McDonald's at 718 American Legion Highway goes before the Boston Licensing Board on Weds., Oct. 6, seeking permission to stay open 24 hours a day. The burger outlet is currently open 7 a.m. to midnight.
