Legal question
The report states Rugar SR9 and Rugar P94. Those firearms don't exist. The firearms which due exist are Ruger SR9 and Ruger P94. Can one letter off let these guys walk?
No, the names don't matter.
They all get test fired, and if they can fire bullets, they are considered firearms.
lol are you serious?
lol are you serious?
Only on TV. The don't need to
Only on TV. The don't need to be read miranda rights either.
It's Ruger, not Rugar.
It's Ruger, not Rugar. Shocked that a BPD writer could mess up the name of one of the major US manufacturers.
those guns did not get
those guns did not get aquired in Mass they are not sold here with more than a 10 round capacity
Maybe this is what the French
Maybe this is what the French were talking about?
So Monday morning their
So Monday morning their ridiculously low bail is set, and they're free to murder someone?
Free to play golf too.
Or go to the movies. Or yea, they could murder people.
But they are in fact gun
But they are in fact gun-carrying, gang affiliated, teens. I won't be expecting them to ask if they can play through.
And how would you propose bail be set?
Try it out... see if you can come up with a reasonable set of guidelines.
Running a court, just like quarterbacking an NFL team, might actually be a little more subtle and complex than the monday-morning quarterbackers might have you believe.
Simple
Base it on the severity of the charges against the suspects. And while we're at it, we should lose the "too young to have their name released" BS and all the other special and unjustified protections we give suspects of serious crimes just because of their age.
Quarterbacking is simple, too.
Just call a play, find an open man, and drill a pass to him. I can't imagine why they make it out to be such a big deal.
Isn't your proposal...
... tantamount to giving the police the unsupervised authority to lock people up without bail? Could you imagine a planet, perhaps quite different from yours, in which even the best-intentioned people act badly when given excess authority?
Bail is intended to ensure people show up for their trial
If the prosecutor wants to keep them in jail, s/he needs to have a dangerous (ness) hearing. At that hearing if the judge agrees that they are not safe to let go, they don't get an option of bail.
You know, that whole innocent until proven guilty thing. Details, details, ...
Agreed. And Suffolk County
Agreed. And Suffolk County doesn't hold dangerousness hearings for firearms offenses.
Nope. How long have you
Nope. How long have you lived in Massachusetts? Firearms offenses are treated very seriously here, they are some of the strictest laws in the nation, particularly since this will likely trigger a mandatory minimum sentence. By the way, the purpose of bail is solely to ensure that the defendants will appear in court. Since these are local kids with ties to the area and likely not a lot of financial help, they are not considered a flight risk. And since it's Suffolk County there's no dangerousness hearing like in other counties to keep these kids detained pre-trial for public safety reasons. Complain all you want but the system is not set up to house everyone for pretrial detention.
Suffolk County Bails for Gun
Suffolk County Bails for Gun cases are routinely in the 10's of thousands of dollars - it is basically automatic.
Saw it
Yea, I watched this happen as did the entire two block radius. Hundreds of kids came out of the house, roaming the entire block and trying to hide in the backyards from police. Went on for more than an hour. Landlord is a slumlord. House is a flophouse. Has been home to harem of hookers, drug abusers, etc. for years. Not long before they actually had a live band playing up there. You could hear it more than a block away. This is Dorchester, and until guns are involved, cops don't get all that concerned. If you want quiet, move to the suburbs, is the general attitude.
