Woburn man charged with raping unconscious woman at Felt

UPDATE: Charge dropped.

Nicholas Chiaraluce, 21, of Woburn, is expected to be arraigned this morning in Boston Municipal Court on a count of aggravated rape, according to the Suffolk County District Attorney's office. Prosecutors will allege he raped an unconscious woman in a restroom at Felt, 533 Washington St. late Friday or early Saturday. He was released Saturday on $50,000 bail.

Again, this is from the Suffolk DA's office and again, presumption of innocence until found guilty (this is from a press release, which you can read here).

Club employees told responding Boston Police that a patron had seen Chiaraluce having sex with an unconscious woman when he went to use the establishment's second-floor men's room. Police spoke with that patron, who told them that he had gone to use the bathroom and observed Chiaraluce having sex with the unconscious victim on the toilet.

Boston Police also spoke with a friend of Chiaraluce, who told them that Chiaraluce had called him and asked him to come up to the second-floor men's room. When he arrived, the man said, he saw the victim with her pants around her knees and Chiaraluce asked him to help him dress her. The man refused.

While speaking to officers, Chiaraluce allegedly made statements indicating that he did not know the victim but had bought her a drink. The officers observed what appeared to be either blood or vomit on his pants; they seized those pants and a pair of women's underwear recovered from the bathroom.

The victim, a 21-year-old Boston woman, was transported to an area hospital. Club employees have been cooperative with investigators, Conley said.

He pleaded innocent today and was released on $30,000 bail. He is due back in court for a probable-cause hearing on March 5.

The Globe reports on what he told reporters after the hearing:

"I did everything I could to make sure she was OK," Chiaraluce said. "I was trying to do the right thing, and I ended up getting charged."

His father was quoted, too, wondering what the woman was doing in the men's room.

It's sort of pathetic and desperate for ANYONE to have (presumably non-consensual) sex with a woman who is passed out drunk. Is it because a 'live' one is too much of a challenge?

It's downright vicious, and a clear case of taking advantage of somebody who's clearly in a vulnerable position to begin with, imo.

My name is Jessica Kelleher. I used to work with Nicholas Chiaraluce at a family owned bakery for almost 2 years. I know in my heart that he did not rape this woman. Nick is a gentle, kind hearted individual who used to always make me laugh and smile at work. He was very hard working and always cared about others around him. I will stand by him 100 percent. Keep your head up Nick! I know you are innocent!
