No title of nobility shall be granted by the United States: and no person holding any office of profit or trust under them, shall, without the consent of the Congress, accept of any present, emolument, office, or title, of any kind whatever, from any king, prince, or foreign state.
My guess
I'm guessing that since both houses of Congress were present without uproar that they gave their consent.
By the way, the article title here reminds me of this:

So he's not suddenly a member of the House of Lords and he didn't suddenly become a Knight of the Garter or Roundtable or whatever they call it these days and he doesn't have to bow to the queen.

Thanks for the civics lesson, but...
Despite Brown referring to Kennedy as "Sir Edward Kennedy", the reality is that he's not becoming "Sir Edward Kennedy" as he's neither a citizen of a Commonwealth country nor a British subject. He doesn't get the title of nobility, he gets none of the rank or privileges of being named a knight. He'd have to become a British subject for that, and even then he'd have to make a request to the Crown that his honorary knighthood be converted to an actual knighthood-- more evidence that this isn't a real title. It's the same as being named an honorary member of a police department or a fire department-- it's a nice thing to put in a biography, but nobody is going to let you sit on the truck and try to put out a fire.
Also, it's clear that nobody involved in this decision considered for a moment the field day that Howie Carr is going to have with this.
