Grand Canal gets five-day suspension for bouncers beating up patrons

The Boston Licensing Board last week ordered Grand Canal, 57 Canal St., to shut for five days as punishment for a March 24 incident in which one bouncer was videoed repeatedly kicking a customer in the head and in which a second bouncer inflicted severe enough injuries on three other patrons to warrant sending them to the hospital as well.

The punishment is unusually severe for the board, which typically limits its punishments to one or two days.

Grand Canal, which acknowledged the incident did, in fact, happen at a hearing last week, could appeal the punishment to the state Alcoholic Beverages Control Commission.

The alleged head stomper, Sidney Phillips, 31, of Avon, faces a charge of assault and battery with a dangerous weapon; the bar says it fired both him and the second bouncer. Phillips cost the bar another five-day suspension for allegedly punching out another customer in December.

I suppose they'll be civil suits,too. How does the owner/management afford to deal with this?

Were other employees out there encouraging the behavior of the bouncers?

How do you propose they punish the owner, when they can't fine him directly for making terrible hiring/policy decisions? They could, in theory, yank his license, but that never seems to happen to people with connections to the board, and that would be equally as punitive to the rest of the business anyway.

Not only is the employer responsible for the employees, but in this case there were several complaints of the bouncer assaulting people for no good reason. It wasn't an isolated incident.

It's unfortunate the other employees of the bar will now loose nearly a weeks pay.

They would probably get fired for claiming unemployment. Of course, they can't simply open their own bar, thanks to the finite licenses. This is the biggest impasse in labor law today.
