State: Kineavy shouldn't have double deleted

The Globe reports Secretary of State Bill Galvin has ruled Michael Kineavy "inappropriately" deleted e-mail messages that should have been preserved as public records. He's referred the case to Attorney General Martha Coakley, who is no doubt relieved she won't have to decide what to do until after Nov. 3.

Court rejects request to keep Jim Marzilli away from every woman in the state

The Massachusetts Appeals Court today rejected a lawsuit by three women who said they were groped by the disgraced ex-state Senator that would have forced him to keep his distance from all women in Massachusetts.

The court ruled that the provision of the state civil-rights law that was also used to limit anti-abortion protesters near abortion clinics can only be enforced by the state's attorney general and that the three women could ask for no more than an injunction to keep Marzilli away from them, not every woman in the state. And even then, the court ruled, there is no proof Marzilli has attempted to assault or harass them since his arrest in 2008, so there is no longer a reason for an injunction.

The women could appeal to the Supreme Judicial Court.

Complete decision.

Car-crashing grope denier could get onto Senate ballot

The Herald reports Jack E. Robinson filed 10,900 signatures at the last minute to get onto the Republican ballot for the special Senate election. As long as 10,000 of those signatures - which the Herald says he spent $100,000 to collect - are valid, he'll face off against Swearin' Scott Brown in the primary.

Ever the optimists, Red Mass. Group explains why this will actually help Brown win the final election.

Speaking of Brown, the Herald reports the ex-Cosmo model is married to an ex-"murderous, bikini-clad vixen" from a Digney Fignus video, or, in other words, Channel 5 reporter Gail Huff.

The Financial District deli that forecasts the economy

Larry Cheng explains how he gets his finger on the pulse of the economy by chatting with the owner of the Grassroots Deli on Devonshire Street - and he reports that pulse is still weak:

Fall 2009: Hopes of a pick-up in business after Labor Day have now faded. Business is still very slow. She said her paper supplier who has been working the Boston and Cape Cod region for 38 years said his business in Cape Cod fell by more than $1 million year over year. It's at its worst point in 38 years.
