Man charged with robbing woman in wheelchair, pushing her onto trolley tracks

A Brighton man is charged with robbing a 67-year-old woman in a wheelchair of $10 at the inbound trolley stop at Huntington and Longwood last night, then pushing her onto the tracks.
The woman's screams attracted bystanders, who stayed with her until police arrived. Wentworth Institute of Technology and Boston Police spent some time scouring the area looking for Jerdon Brooks, 48, then got word he was back at the scene of the crime, boarding a trolley - from which they grabbed him and arrested him on charges of unarmed robbery and assault and battery on a disabled person.

Arraigned this morning in Roxbury District Court. Prosecutors recommended that he be held on $10,000 cash bail; bail was set at $5,000 and he was ordered to return to court on July 19 with attorney Chris Bracci. Under Massachusetts law, assault and battery on a person who is 60 or older, or who has a long-term mental or physical impairment, carries a harsher maximum penalty (three years in prison) than assault and battery on a person under 60 who does not have such an impairment (two and a half years in a house of correction).

How about the theft? And couldn't it possibly be tried as attempted murder?

The theft was charged as unarmed robbery (there's no victim-specific statute for that offense as there is with A&B). Proving assault with intent to murder requires proving the specific intent to kill someone, with malice. I don't see those elements here, as appalling as the allegations are, but the case will be reviewed by senior prosecutors like all felony complaints.

Only because this guy probably has around 30-70 prior convictions.

At his arraignment in Roxbury District Court, according to the Suffolk County District Attorney's office, which adds he was on probation for a 2009 drug arrest.
Also, he faces three years in state prison on the assault and battery charge, rather than 2 1/2 years in a county jail because of the age and physical impairment of his alleged victim.
this robbery has drug addict written all over it
his probation will be revoked and he'll have to serve out the rest of that sentence in addition to the sentence from the new robbery.
