State bans caffeinated alcohol in a can immediately:
The FDA ruling clearly states that these beverages are unsafe. Beginning today, all retailer and other businesses licensed by the Alcoholic Beverages Control Commission are prohibited from selling, storing, importing or transporting these products in Massachusetts.
The Alcoholic Beverages Control Commission is declaring that alcoholic beverages with added caffeine are adulterated under state law. These products must be taken off the shelf immediately. Wholesalers must retrieve these products at or before their next delivery to retail licensees.

does this mean that coffee and chocolate stouts are banned too?
I believe Sam Adams has one, or at least has in previous years. Harpoon, too.
probably not...
it does not appear to be a total ban of all alcoholic beverages that contain caffeine. the law specifies drinks that have caffeine as an "added ingredient", which seems to differentiate it from ingredients that have their own natural caffeine (such as coffee and chocolate). your chocolate stout is probably safe, unless they add additional caffeine.

I don't normally have caffeine at night but I think I'm going to dunk three coffees into my next drink, apparently it's so awesome it got banned.
Who says government's not efficient
I'm kind of amazed by how quickly state and federal agencies acted on this. It's only been a couple of weeks since the Four Loko thing hit the news and already there's bans

. . . about the effect of these types of drinks because I'm allergic to alcohol- tend to break out in handcuffs.

Pointless
Thank god the state is protecting our innocent young people from getting blackout drunk. Because surely Four Loko and caffeinated beer is the only way they can do this. And clearly no one can drive to New Hampshire or any of the other surrounding states to buy it.
