Seems this guy in New Brunswick, NJ, wants to open an "upscale" restaurant and bar called Buck Foston's Roadhouse, but the mayor, who happens to be "an avowed Red Sox fan" opposes him. Naturally, the guy's making a federal case of it, filing a federal lawsuit against the city after the city council refused to take action on his plan to turn an old Bennigan's into an anti-Sox zone with burgers and beer.

In his suit, Lawrence Blatterfein accuses Mayor James Cahill of being a Sox-loving infringer of the First and Fourteenth Amendment who never objected to a chicken franchise called Cluck U (according to the suit, the mayor said he didn't object to that because "chickens cluck"). The suit adds:

For avid sports fans, the play on words "Buck Foston's" is evocative of a century-old sports rivalry between the New York and Boston sports teams, including between the New York Yankees and the Boston Red Sox, the New England Patriots and the New York Jets and New York Giants and between the Boston Bruins and the New York Rangers. In selecting the name "Buck Foston's," Blatterfein intended to attract to his restaurant the large population of New York sports fans in and around New Brunswick.

Two alleged gun-packing drug dealers charged with attacking cops during stop

Norberto Barreto, 31, and Arkie Swinson, 30, both of Dorchester, were arraigned today on two counts each of unlawful possession of a firearm, unlawful possession of ammunition, and assault and battery with a dangerous weapon, for an incident Friday morning that started on Cheney Street in Roxbury, the Suffolk County District Attorney's office reports.

Police: Woman beaten up in South Station restroom; two arrested

Brown (l) and Wilton. Brown (l) and Wilton. A woman cleaning up in a South Station restroom early this morning found herself under attack by two other women apparently upset she'd put her belongings on a counter, MBTA Transit Police report.

Melissa Brown, 31, of Worcester, and Jasmine Wilton, 20, of Lynn, were both charged with assault and battery with a dangerous weapon following the incident around 5:40 a.m., police say.

According to police, the victim, a 44-year-old woman from Somerville, was in the restroom when the two other women entered. She asked them to be careful of her belongings, in particular a black back in which she told them she had her pet cat. According to police:

The suspects became irate and stated to the victim, "get your pussy off of the counter." The suspects then began to push all of her belongings off of the vanity and physically assault her by punching her several times, pushing her to the ground and kicking her repeatedly.

She began to scream, which brought a security guard, who summoned police - who found the two attempting to leave the station by way of the track area "in a quick manner."

State charges Dot. Ave. bar tries to keep blacks, Cape Verdeans out

The state Attorney General's office said today it's sued Peggy O'Neil's, 1310 Dorchester Ave., for alleged civil-rights violations.

The suit alleges that on at least three occasions - the most recent this past April - bouncers made a point of keeping minorities out while letting in whites. The state alleges that on one night in December, bar owner Caron O'Neil herself blocked two men of Cape Verdean and African-American descent from entering, telling them she did not "want any trouble." Then later that night:

A second group of friends of Cape Verdean, Spanish and African American descent went to the bar and were also allegedly denied entry by bar staff. Bar staff asked them for their identification cards which they provided. The bouncer allegedly asked them if they knew the owner of the bar and who they were there to see. At the same time, other Caucasian customers were allowed to enter the bar, many of whom appeared to be intoxicated. According to the lawsuit, Ms. O’Neil told the group that they could not come in the bar because they did not know the bar"s owner. She allegedly stated to them, "You don't look like the type of people" the owner would know and "we don't like people of your kind here" among other statements.

The state is seeking an end to the practice and monetary damages.

Out of towner charged with smashing $10,000 worth of china at Back Bay hotel

Boston Police report arresting a disgruntled and allegedly soused New Hampshire man at the Marriott Copley Place around 2:20 a.m., Sunday:

On arrival, officers spoke to hotel security who stated that the suspect, who was being detained, entered a kitchen inside the hotel and proceeded to smash dishes, glasses, coffee cups and saucers, essentially anything he could get his hands on. Officers entered the kitchen and observed the remnants of broken dishes, glasses, coffee cups and saucers strewn about the floor.

When asked to explain the damage, the suspect apologized and stated that his temper got the best of him. While talking to the suspect, offices were able to detect an odor of alcohol emanating from the suspect. The hotel estimates that approximately $10,000 worth of damage was done to the glassware.

At that point, it was a bit late for an apology, police say, so officers arrested Daniel Ward of Nashua on a charge of willful and malicious destruction of property.

According to the Suffolk County District Attorney's office, Ward was not a guest at the hotel, but said he was angry at some people he was trying to get away from at that point. The DA's office reports he was released on personal recognizance and was ordered to return to court on Oct. 24.
