Man facing drug charges sues DA

The Globe reports on the lawsuit by Pasquale Capogreco of Winthrop, who alleges the DA dropped drug charges against an East Boston acquaintance because the guy's brother is East Boston state Rep. Carlo Basile. DA Dan Conley and Basile both deny the charges.

Massachusetts Supreme Judicial Court decisions dating back more than 100 years and continuting through the present day clearly show that the intention, even the preparation, to do something without an overt act toward doing it is insufficient to charge someone criminally. A Globe reporter reviewed the documented case law at length yesterday, though it never made it into the paper.

The facts in this case suggest an intended drug deal that was interrupted before it could be consummated. When police stopped the vehicle, it was Capogreco who presented them with prescription pills on his person and in the vehicle he was driving; the passenger had only cash. Possession of a Class C substance with intent to distribute is a crime, whereas possession of cash -- even with the intent to buy drugs -- is not. Had prosecutors ignored the law and charged the passenger, any judge would have dismissed the case and criticized the decision.

No consideration at all was given to the passenger's familial connections (it must be noted, in fact, that the rep took office only after his brother was arrested). The charging decision was based on the facts and the law, and the allegation of political influence is unfounded, unwarranted, and irresponsible.

At the heart of the influence allegations is a revision Boston police made to the original arrest report and the way former East Boston District Court Judge Paul Mahoney and Clerk Magistrate Joseph R. Faretra reacted in October 2007 when Capogreco and Anthony Basile were arrested and appeared in court.

Not so clear cut as you suggest. Also...

Faretra said he does not recall meeting with Anthony Basile on Oct. 26, 2007, as Capogreco asserts in a sworn affidavit.

"I do not recall" generally means "I need to be careful I don't get charged for lying," no?

You seem to have left some things out. I reccommend that anyone interested read the article.

Neither Faretra nor Mahoney work for the district attorney's office -- very clear cut.

Just as important is that this case went before the grand jury, where the entirety of the evidence was presented and the passenger could have been indicted even without a district court complaint. No such indictment was returned because the facts, the evidence, and the law would not support one.

Conley owed Basile a favor from when Basile ran a headquarters in East Boston for him.

But wht isn't anyone talking about Capogreco's connections.
His home has been visited numerous times by former Senate Presidente Bob Travaglini, and Mike Flaherty from the Boston City Council. Capogreco is a known money man for Flaherty, Sjeriff Andrea Cabral, and Mayor Meninno.

Why did they desert him? After all he's a career Meninno hack/ I guess working as a Meninno Health inspector just doesn't pay the bills anymore.

The Pasquale that you are talking about with all these connections is the wrong Pasquale. Different person with the same name.
